CARETAKER APPOINTMENT AGREEMENT

The engagement of a paid caretaker to look after a property, without any interest in it

Parties

1. The Owner — __________, __________, resident of __________, mobile __________, email __________ ("the Owner").

2. The Caretaker — __________, __________, of __________, mobile __________, who has shown the Owner __________ ("the Caretaker").

Background

A. The Owner owns the property at __________, in __________: __________ ("the Property").

B. The Owner engages the Caretaker, for a wage, to look after the Property on the Owner's behalf.

1. The engagement

1.1 The Owner engages the Caretaker from __________ until the engagement is ended under clause 5.

1.2 The Caretaker's working hours are: __________.

1.3 The Owner will pay the Caretaker a wage of __________ a month, on or before day 7 of the following month, by bank transfer or against a signed receipt. The wage is not less than the minimum wage payable to the Caretaker under the law in force.

1.4 The Caretaker consents to the Owner having the Caretaker's antecedents verified by the police.

2. The Caretaker's duties

2.1 The Caretaker will carry out these duties:

2.2 In every case the Caretaker will tell the Owner at once of any trespass, attempt to occupy, damage, theft, leak or fire, any notice from an authority, and any visit by anyone claiming a right to the Property.

3. The Caretaker holds the Property only for the Owner

3.1 The Caretaker is not a tenant or a licensee of the Property, and pays no rent or fee for it. Possession of the Property stays at all times with the Owner, and any presence of the Caretaker on the Property is on the Owner's behalf.

3.3 Nothing the Caretaker does, and no length of time the Caretaker spends at the Property, gives the Caretaker any right, title or interest in it, or any right to stay there after the engagement ends.

3.4 The Caretaker will not let the Property or any part of it, allow any person to stay there, or part with the keys to anyone except the Owner or a person the Owner names in writing.

3.5 The Caretaker will not collect rent or any other money for the Property unless the Owner has authorised it separately and in writing.

3.6 The Caretaker will not alter the Property, or keep anything there that does not belong to the Owner, apart from the Caretaker's own personal belongings in any room provided.

4. Keys

4.1 The keys handed to the Caretaker are listed in a signed custody receipt, are held for the Owner, and may not be copied.

5. Ending the engagement

5.1 Either party may end this engagement by 30 days' notice in writing. The Owner may end it at once for theft, violence, allowing anyone to occupy the Property, or any breach of clause 3.

5.2 Within 7 days after the engagement ends, the Caretaker will hand back every key and access device, remove the Caretaker's personal belongings, and leave any room provided, and the Owner will pay the wage due up to that day.

5.3 If the Caretaker does not leave within that time, the Caretaker's continued presence is without the Owner's consent, and the Owner may take proceedings to recover possession. The Owner will not use force.

6. General

6.1 This agreement is governed by the law in force in __________, and only the courts having jurisdiction where the Property is situated may decide a dispute about it.

6.2 A notice under this agreement is given in writing, by hand or by email, to the address given for the other party above.

Personal data

This notice is given under the Digital Personal Data Protection Act, 2023.

The names, addresses, telephone numbers and email addresses in this document are collected for one purpose: engaging the Caretaker, paying the wage, and recording who holds the Property's keys. The Owner and the Caretaker each keep a copy. It may be shown only to the Owner, the Caretaker, and the police for the verification in clause 1.4, and it will not be used for marketing.

If the engagement does not go ahead, the personal data in this document is kept for 90 days from that decision and then erased. If it goes ahead, this record is kept for the term of the engagement plus 12 months and then erased, unless a law requires a particular record to be kept longer.

Consent to the use of personal data in this document may be withdrawn at any time by writing to __________. A request to correct inaccurate data, to erase data once its purpose has ended, or to complain about how it has been handled may be sent to the same address, and will be answered within 30 days.

This document does not collect a full Aadhaar number or a copy of an Aadhaar card; the identity document is recorded by type and its last four digits only, and a voter identity card, driving licence or passport is equally acceptable.
