4A. EXACT FRACTION AND SOURCE

The share being sold should be traced to the seller’s title source and expressed as the same fraction/percentage reflected in the parent ownership record. If inheritance or multiple transfers changed the fraction, the chain should be reconciled before completion. A description such as “my first-floor share” is insufficient where the registered title remains an undivided fractional interest.

4B. NO IMPLIED FLOOR TITLE

Occupation of a particular floor, room, courtyard or parking area may arise from convenience or family arrangement. Unless a legally effective partition or conveyance identifies that portion as a separate title, the agreement should not promise exclusive ownership of it. The buyer may receive the seller’s existing joint-use position, but that is different from receiving a separately demarcated legal parcel.

5A. CO-OWNER COMMUNICATION

The buyer should identify all co-owners from the title/revenue/municipal record and review any co-ownership agreement, family settlement, litigation or restriction affecting transfer or use. A co-owner NOC can be useful evidence but should not be treated as unnecessary or conclusive without checking the actual legal context. The seller cannot release another co-owner’s independent rights through this bilateral agreement.

5B. COMMON SERVICES AND REPAIRS

Water tanks, entrances, stairs, roofs, drains, structural walls, driveways and utility meters may be shared. The buyer should understand how repair expenses and access are presently managed. Existing informal sharing practices should be documented if the buyer is expected to continue them, while recognising that a future co-owner dispute may require a separate settlement or partition process.

5C. TENANTS AND FAMILY OCCUPANTS

Any tenant, licensee, family member or caretaker occupying part of the parent property should be disclosed. The seller cannot promise vacant possession of areas controlled by another co-owner or lawful occupant unless the seller has the legal ability to deliver it. A buyer acquiring only an undivided share should not assume a right to evict or exclude other co-owners from joint property.

6A. PARTITION NOT GUARANTEED

The buyer may later seek consensual or legal partition, but this agreement does not guarantee that a particular physical portion will be allotted to the buyer. Factors relevant to partition can include title fractions, physical divisibility, access and existing rights. If the transaction depends on a specific partition outcome, completion should be expressly conditional on a completed valid partition instrument/order.

6B. JOINT POSSESSION

Where no valid partition exists, possession delivered at completion should be described as joint/symbolic possession consistent with the undivided interest, together with any disclosed use arrangement. The seller should not sign a possession memo asserting exclusive delivery of the whole property. The buyer likewise should not change locks or obstruct co-owner access merely on the strength of the share conveyance.

7A. PRICE BASIS

The price is for the stated undivided interest and should not be justified solely by the market value of a physically occupied floor unless the parties understand the title distinction. If a separate use arrangement materially affects value, it should be disclosed and reviewed. The agreement should not convert that arrangement into a representation of exclusive title.

7B. FUTURE SALE OR MORTGAGE

After conveyance, the buyer’s ability to sell, mortgage or develop the undivided share may be affected by lender requirements, co-owner arrangements and physical indivisibility. The seller gives no promise that a future lender will accept the share as standalone security. The buyer should consider these practical consequences during diligence rather than after registration.

7C. COMPLETION DOCUMENTS

Completion should include the parent title chain, documents establishing the seller’s fraction, relevant co-owner communications, current property/revenue records and the conveyance of only the stated share. Any document that describes an exclusive floor should be used only if supported by the legal title/partition structure.

PERSONAL DATA NOTICE

This notice is given under the Digital Personal Data Protection Act, 2023. Personal data in this document is collected only to document and perform the purchase of the stated undivided co-ownership share and conduct co-owner/title diligence, communicate about that purpose, verify expressly supplied transaction information, and retain an evidentiary record.
