1. THE WILL THIS CODICIL AMENDS

My said Will has not been revoked by me. It remains my last Will, subject only to the alterations made by this Codicil and by any earlier codicil of mine that has not been revoked.

Each alteration below takes effect exactly as stated and no further. Where wording is reproduced in quotation marks under an alteration, that quoted wording, and nothing else, is the provision which my said Will is thereafter to be read as containing. Where an alteration revokes a clause and no such quoted wording follows it, that clause is deleted and nothing is substituted in its place.

4. DECLARATION BY THE TESTATOR

(b) this Codicil has been read over and explained to me in a language I understand, and its contents accord with my instructions and my intentions;

(c) I am making this Codicil voluntarily, and no person has induced, pressured or influenced me to make it; and

(d) I am under no legal disability, and no order of any court restrains me from dealing with my property by will.

HOW TO EXECUTE THIS CODICIL — READ BEFORE SIGNING. THIS PAGE IS GUIDANCE AND IS NOT PART OF THE CODICIL.

  1. No stamp paper. A will and a codicil attract no stamp duty anywhere in India. Print on plain paper.
  2. Two witnesses, together, in one sitting. Section 63(c) of the Indian Succession Act, 1925 requires two or more witnesses, each of whom has seen you sign (or received your personal acknowledgement of your signature) and each of whom signs in your presence. Do not sign first and collect witness signatures later.
  3. Never let a beneficiary witness. Under section 67, a gift to an attesting witness, or to that witness's spouse, is VOID — although the codicil itself survives. This applies to gifts in the original will too, because clause 3 above republishes it. An executor may witness under section 68, but only if that executor takes nothing under the will or the codicil; an executor who is also a beneficiary — very common in family wills — loses that gift by attesting.
  4. Initial every page — you and both witnesses — and staple the pages so none can be substituted.
  5. Keep the codicil with the original will. A codicil that cannot be found with the will it amends may never take effect. Tell your executor where both are kept.
  6. Registration is optional (section 18(e), Registration Act, 1908) and an unregistered codicil validly amends a registered will. If you do register, attend the Sub-Registrar in person with both witnesses and your ID.
  7. Check what each alteration actually does before you sign. Every clause you name in the change boxes is revoked. If you supplied replacement wording, it appears in quotation marks immediately under that revocation; if no quoted wording appears, that clause has been deleted with nothing in its place. Read clause 2 above against your will, clause by clause, and confirm each is what you intend.
  8. Do not alter this document by hand after signing. Any interlineation, erasure or handwritten change made after execution is unattested and may be disregarded, or may cast doubt on the whole instrument.
