Section 63 remains the will-execution rule. The medical professional issues the certificate; no Sub-Registrar filing, statutory fee or appeal route applies to the certificate itself.

Chandigarh: Sections 59 and 63 apply in the same way. The certificate can accompany a will-registration or later court file, but the medical professional does not decide probate or will validity. No statutory filing fee or appeal route applies to this certificate.

PERSONAL DATA NOTICE

This notice is given under the Digital Personal Data Protection Act, 2023.

The purpose of collecting personal data in this medical certificate is to identify the testator and record contemporaneous clinical observations relevant to the testator’s ability to understand testamentary decision-making.

The record will be held by __________ and may be shared with the testator, examining doctor, executor after death, competent court and legal professionals handling a will challenge or estate administration.

If the matter does not proceed, the personal data will be retained for 90 days and then erased. If the matter proceeds, the record will be retained for the matter plus 12 months, except where a statute requires a longer named retention period.
