Mutual Partition Agreement Between Co-Owners

Answer what you can. The draft beside these boxes is rewritten as you go, so you can see exactly what each answer does to the document.

What you type stays in this browser. Nothing is sent anywhere until you choose to keep a copy — and closing this tab loses it.

Your answers

Nothing answered yet. There are 40 questions on this form.

Still to answer

20 answers are still to come.

Nothing is amiss in what you have written. The document is simply not finished, and the draft marks each gap where an answer will go.

  1. The property
  2. The co-owners and the division
  3. The allotment
  4. Dues, documents and authority
  5. The agreement to partition
  6. Signing

Step 1 of 6

The property

What property regime applies?Needed
What is the property address/location?Needed

A long answer. Several lines are fine, and a break you make between paragraphs is the break the document keeps.

An amount in rupees. Commas and a ₹ sign are both fine — write it the way you would write it anywhere else, and the document is given the tidy form of it.

Clearing empties every box on this form, and there is no way back to what was in them.

The live draft

The draft, as it stands

This is the whole document, not a sample of it. It is rewritten every time you change an answer.

A long blank line — __________ — stands wherever an answer has not been given. It is left that visible on purpose, so an unfinished document cannot be mistaken for a finished one.

No answer has been given, so every place a detail belongs is standing blank. The shape of the document is worth reading even now.

LEGAL BASIS

Punjab: This template is drafted as an agreement to execute a later operative partition. For stamp duty, section 2(15) of the Indian Stamp Act, 1899 makes an agreement by co-owners to divide property in severalty an instrument of partition, so Article 45 applies; if the signed document itself creates separate title, section 17(1)(b) also requires registration. Punjab authority property remains subject to section 43(7). The stamping note sets out how the Article 45 duty is assessed.

Chandigarh: The same substance test under section 17 applies. A later operative partition must be registered, and sector property must be reflected in the Estate Office file. The stamping note sets out the Article 45 duty; the Estate Office fee was not confirmed. Rule 16 of the Chandigarh Estate Rules, 2007 and Rule 14 of the Chandigarh (Sale of Sites and Buildings) Rules, 1960 both forbid fragmentation of a site or building, and the Supreme Court held on 10 January 2023, in Residents Welfare Association v. Union Territory of Chandigarh, that a residential unit in Phase-I may not be fragmented, divided, bifurcated or apartmentalised. Check the Estate Office position before dividing a sector site or building by metes and bounds.

Reading costs nothing. Keeping a copy needs an account.

The opening of the draft is on this page as you answer it. Once every answer is in, the button below opens the whole draft, watermarked — still without an account. Printing it, or keeping a clean copy, is where an account is asked for. That is the whole arrangement.

A kept copy has to belong to somebody, and that is the reason for the account. There is nothing further to it.
