ਸਟਾਂਪ ਡਿਊਟੀ

No stamp duty on the application itself — not an instrument, since it creates no right; plain paper. Some counters want a small court-fee stamp (local practice — UP/Haryana more often than Delhi/Maharashtra/Karnataka; ask first, and an online application never needs one). The COPY itself is technically chargeable under Article 24, Schedule I, Stamp Act, 1899 — but exempted, since section 57 expressly requires the officer to furnish it; you pay only the search/copying fee under the state's Table of Fees, not stamp duty (a few states have amended this locally — check if a counter insists otherwise). A representative's letter of authority may count as a power of attorney (s.2(21)) — most counters take a plain signed letter, some want small stamp paper (Rs 10-100) or notarisation. If you're filing an affidavit about a lost original, THAT is chargeable — Rs 10-100 non-judicial stamp paper, e-stampable — verify the current state figure before buying.

Not registrable — section 17, Registration Act, 1908 doesn't reach a request to an officer. This is a section 57 application, fees under the state's Table of Fees, filed where the register book actually sits (or the state portal) — insist on an acknowledgment/token number and a fee receipt. If the deed was never actually registered, no certified copy exists to issue.

Two side doors: a lost-original affidavit — sworn before a notary or oath commissioner; and a representative's letter of authority — usually plain, sometimes notarised, or a registered POA if they do more than fetch a copy. It won't grant access to a Book No. 3/4 document you're not entitled to.

1. Who is applying

1.1 I am Rajesh Kumar Verma, resident of C-14, Second Floor, Lajpat Nagar IV, New Delhi 110024. My mobile number is +91 XXXXX XXXXX. For identification I produce and enclose a self-attested copy of my Aadhaar card ending 4417.

1.2 I am applying in the following capacity: a party to the document — I executed it, or it was executed in my favour.

1.3 More particularly: I am the purchaser named in the deed. My name appears there as 'Rajesh Kumar' without the surname; my Aadhaar reads 'Rajesh Kumar Verma'.

1.4 The property which the document purports to affect belongs to me, and in proof of my ownership I produce and enclose: Registered Sale Deed dated 18 March 2011, Regn. No. 4321 of 2011, and municipal property tax receipt for 2025-26.

1.5 Sunita Verma joins in this application as a second applicant and signs it below. Please treat both of us as applicants and issue the copy to either of us.

2.1 The document is a Sale Deed (bainama). It is more precisely described as: Deed of Exchange between two adjoining plot owners.

4. Why I am entitled to ask for this copy

4.1 Section 57 of the Registration Act, 1908 requires the registering officer to allow inspection of the register books and the indexes and, on payment of the prescribed fees, to give certified copies of the entries in them.

4.2 For a document entered in Book No. 1, which is the register of non-testamentary documents relating to immovable property, section 57(1) allows any person who applies and pays the fee to have a copy. No special interest has to be shown. That is why an intending purchaser, a lender or an advocate is entitled to trace a chain of title.

4.3 For a document entered in Book No. 3, which is the register of wills and authorities to adopt, section 57(3) is narrower: a copy is given only to the person or persons who executed the document, or to their agents or representatives. On the death of the executant, and not before, a copy may be given to any person who applies and satisfies the registering officer that the executant has died.

4.4 For a document entered in Book No. 4, which is the register of miscellaneous documents that do not relate to immovable property — a power of attorney, a partnership deed or an adoption deed, for example — section 57(4) allows a copy to be given to any person applying, provided that the entry relates to a document executed by that person, or executed in favour of that person, or which purports to affect property belonging to that person, or that the applicant is the agent or representative of such a person. The owner of property is therefore entitled to the office's copy of a power of attorney, or of any similar document, which somebody else has executed purporting to deal with that property, even though the owner never signed it and it was never made in his favour.

4.5 I make this application on that basis, in the capacity stated in paragraph 1.2, and the papers listed in paragraph 10 are produced in proof of that capacity.

5. Why I need the copy

5.1 I need a certified copy because the original has been lost or misplaced.

5.2 The circumstances are these: The loan against this flat was taken in 2019 and the original sale deed has been in the bank's custody since then. The mutation office at the municipal corporation will not accept a photocopy.

The original is not traceable. I have reported the loss to the police. The particulars of the report are: Lost Report No. LR/2026/1147 dated 12 August 2026, PS Lajpat Nagar, New Delhi. A copy of the report, and my affidavit about the loss, are enclosed.

The original is in the custody of a lender. The original deed is held by HDFC Bank Ltd, Nehru Place Branch, New Delhi as security for a loan and cannot be released to me at present. A letter or acknowledgment from that institution confirming custody is enclosed.

A party to the deed has died. Late Shri Om Prakash Verma, who was a party to the document described in paragraph 2, has since died. The death certificate and the papers showing my relationship as a legal heir or successor are enclosed. I apply as a person claiming under that party.
