LEGAL BASIS

In Punjab a Non-Encumbrance Certificate is applied for through the Non-Encumbrance Certificate Issuance System on rcms.punjab.gov.in, over the counter at the Sub-Registrar's office, or through a Sewa Kendra; its issue is a notified service under the Punjab Transparency and Accountability in Delivery of Public Services Act, 2018, with a limit of three days, a first appeal to the Sub-Divisional Magistrate and a second appeal to the Deputy Commissioner. It is a certified statement of what the registers of that office, including Book No. 1 and the index of properties kept under section 55 of the Registration Act, 1908, disclose for the property and the period searched. It cannot report an equitable mortgage created by deposit of title deeds, an unregistered agreement, an oral or family partition, a tenant in possession or a statutory first charge, and a registered lis pendens is the only litigation it will show, so run the property-under-litigation search on the same portal as well. Chandigarh has no notified Non-Encumbrance Certificate service, but the Registration Act, 1908 applies there: the Sub-Registrar at the 30 Bays Building, Ground Floor, Sector 17 keeps Book No. 1 and the index of properties under section 55, and section 57 entitles any person to inspect them and obtain copies. The searches that decide a Chandigarh title are Know Your Property and Know Your Dues on estateoffice.chd.gov.in and a No Dues Certificate from the Estate Office.
