APPLICATION FOR DEMARCATION (NISHANDEHI) OF THE BOUNDARIES OF THE ABOVE-DESCRIBED LAND AND FOR THE ERECTION OF BOUNDARY PILLARS (BURJIS), MADE UNDER CHAPTER IX (BOUNDARIES AND BOUNDARY MARKS) OF THE PUNJAB LAND REVENUE ACT, 1887, READ WITH THE NOTIFIED SERVICE OF LAND DEMARCATION UNDER THE PUNJAB TRANSPARENCY AND ACCOUNTABILITY IN DELIVERY OF PUBLIC SERVICES ACT, 2018

RESPECTFULLY SHEWETH:

PART A — THE APPLICANT AND HIS INTEREST IN THE LAND

1. That the applicant is __________. The land to which this application relates (hereinafter called "the said land") stands entered in the Jamabandi for the year __________ of the revenue estate of Village __________, Tehsil __________, District __________, at Khewat No. __________ and Khatauni No. __________, and is more particularly described in the Schedule at the foot of this application.

1. That the said land is __________ measuring __________ in the aggregate, and comprises Khasra / Killa Nos. __________.

1. That the interest of the applicant in the said land arises from __________, the particulars whereof are: __________, dated __________. A copy of the said document or record entry is annexed to this application, together with a current nakal of the Jamabandi for the year __________ and a tracing of the tatima shajra of the said khasra numbers.

PART B — THE OCCASION FOR DEMARCATION

1. That demarcation of the said land has become necessary for the following reason, namely that __________.

1. That as to such boundary marks as presently exist upon the ground, the position is that __________. The boundaries of the said land, as those boundaries stand upon the revenue record and as the applicant seeks to have them fixed upon the ground, are set out in the Schedule below. To the extent that the boundaries are not identifiable with certainty upon the spot, the applicant is unable to enjoy and protect the said land to the extent to which the record shows it to belong to him, and is exposed to a continuing risk of loss of area.

1. That save as stated in this paragraph, no demarcation of the said land has at any time been carried out by the revenue agency.

1. That save as stated in this paragraph, no suit, appeal, revision, execution or other proceeding concerning the title to, or the boundaries of, the said land is pending before any civil court or revenue court, and no such proceeding has been decided against the applicant.

PART C — THE ADJOINING HOLDERS TO BE SUMMONED

1. That the persons whose holdings adjoin the said land, and who are therefore necessary parties to the demarcation and are liable to be summoned so as to be present upon the spot at the time of measurement, are the following, whose names, parentage, khasra numbers and addresses are given so that process may issue: __________

That the applicant undertakes to bear the cost of service of notice upon each of the said adjoining holders, to assist the process server in effecting service, and to remain personally present, or to be duly represented, upon the date and at the hour that may be fixed for the spot inspection, together with the original title documents and the revenue papers relating to the said land.

PART D — THE PROCEDURE PRAYED FOR AND THE APPLICANT'S UNDERTAKINGS

1. That the applicant is aware, and accepts, that the demarcation will be carried out upon the spot by the Field Kanungo (girdawar) of the circle, assisted by the Halqa Patwari, by measurement taken from the fixed points of the shajra kishtwar of the revenue estate in accordance with the settlement records and the musavi, and that the applicant is liable to bear the prescribed application fee together with the travelling and daily allowance of the revenue staff, the wages of the labour engaged, the cost of the chain and jarib and the cost of the boundary pillars (burjis) erected upon the ground.

1. That this application is being submitted __________, and the applicant prays that the notified time limit so applicable to the service of land demarcation may kindly be observed.

That the applicant is conscious, and expressly states, that this application seeks only the fixing upon the ground of the boundaries which the revenue record already shows, and does not seek, and cannot result in, any adjudication of title. The applicant further states that under section 44 of the Punjab Land Revenue Act, 1887 an entry in a record-of-rights or annual record is presumed to be true only until the contrary is proved or a new entry is lawfully substituted for it, and that any question of title falls to be determined by the civil court in a suit for a declaratory decree, to which section 45 of that Act directs the aggrieved party.

1. That this application is made bona fide, in the interest of justice, and not with any intention of harassing the adjoining holders or of disturbing any settled possession.

PRAYER

It is therefore most respectfully prayed that this Court may graciously be pleased to:

(a) register this application and issue summons to the adjoining khasra holders named in Part C above, and to any other person appearing to this Court to be interested in the said boundaries;

(b) direct the Field Kanungo of the circle, with the Halqa Patwari, to proceed to the spot upon a date to be fixed and there to demarcate the boundaries of Khasra / Killa Nos. __________ of the revenue estate of Village __________, Tehsil __________, District __________, by measurement carried out in accordance with the shajra kishtwar and the Jamabandi for the year __________;

(c) direct that boundary pillars (burjis) be erected at the corners and turning points of the said land, and that the demarcated boundaries be recorded upon a tatima shajra prepared for the purpose;

(d) direct that the demarcation report of the Field Kanungo, together with the tatima shajra, be placed upon the revenue record of the estate, and that a certified copy of both be supplied to the applicant upon payment of the prescribed copying fee;

(e) pass such further or other order as this Court may deem fit and proper in the facts and circumstances of the case.

And for this act of kindness the applicant shall, as in duty bound, ever pray.
