LEGAL BASIS

In Punjab the completion certificate is issued under rule 14 and the occupation certificate under rule 23 of the Punjab Urban Planning and Development Building Rules, 2021, by the municipal corporation, council or development authority concerned. On a development-authority site, where the completion or occupation certificate is not obtained within the period allowed, the authority charges an extension fee half-yearly, on a ladder that starts in the fourth year from allotment and runs against the site rather than the person. In Chandigarh a building on an allotted or auctioned site must be completed within three years of the delivery of possession under Rule 8 of the Chandigarh Estate Rules, 2007, with up to five yearly extensions on a penalty of 10%, 15%, 20%, 25% and 30% of the total consideration, after which the Estate Officer may proceed under section 8-A of the Capital of Punjab (Development and Regulation) Act, 1952; the building is not to be occupied until the Estate Office issues an Occupation Certificate.
