LEGAL BASIS

In Punjab a death changes the rights in the record rather than correcting it: the heirs' names are entered by a mutation of inheritance (virasat, commonly called the fauti intkal) reported under section 34 of the Punjab Land Revenue Act, 1887 and attested by the Circle Revenue Officer, and a fard badar cannot carry that change. Paragraph 7.30 of the Punjab Land Records Manual bars using a mutation to correct an entry already incorporated in a jamabandi, so a stale entry left behind after a sanctioned mutation is corrected by a fard badar under paragraph 7.29. In Chandigarh a sector property has no jamabandi; a transfer on an intestate death goes through the Estate Office and needs a public notice.
