  1. WHAT WILL FOLLOW IF THE TENANT DOES NOT PAY.

If the Tenant fails to pay or tender the whole of the said sum within
the said period of two months, the Landlord will, without further
notice to the Tenant, apply for recovery of possession of the
premises on the ground specified in section 20(2)(a) of the Punjab
Rent Act, 1995, by an application in the Form specified in Schedule
XII to that Act, presented to the Rent Authority having jurisdiction
over the premises at __________, Punjab. Since the Punjab Rent
(Amendment) Act, 2014, notified on 29 August 2014, the Rent Authority
under section 36(1) is the Subordinate Judge 1st Class, and in
practice that application is filed and heard in the court of the Rent
Controller-cum-Civil Judge (Junior Division) at the District Courts —
the same judicial officer and the same registry, whichever label the
cause title bears. The Tenant is expressly put on notice that the
procedure on such an application is the summary procedure under
section 38 of the Act: the Tenant will be summoned and will be
required to obtain LEAVE TO CONTEST, and an application for leave
must be made within the period allowed by the Act and the summons,
failing which the Landlord's averments may be taken as admitted and
an order for eviction may follow without a trial. In that application
the Landlord will also claim the arrears, the other charges, interest
and the costs of the proceedings.

  1. THIS INDULGENCE IS AVAILABLE TO THE TENANT ONCE ONLY.

The benefit of the two-month period given by this notice is available
to a tenant only once in respect of the same premises. If the Tenant
pays within the two months and thereafter again falls into arrears of
three or more consecutive months, the Landlord will be entitled to
apply for eviction without extending that indulgence a second time.

  1. NO WAIVER, AND NOTHING GIVEN UP.

Nothing in this notice, and no acceptance by the Landlord of any sum
paid or tendered by the Tenant, shall operate as a waiver of any
breach of the tenancy by the Tenant, as the creation of a new
tenancy, as an admission of any fact asserted by the Tenant, or as an
abandonment of any other ground of eviction available to the Landlord
under section 20 of the Punjab Rent Act, 1995 or of any right or
remedy the Landlord may have in law or in equity. All such rights and
remedies are expressly reserved.

  1. HOW THE TENANT IS TO PAY OR TENDER.

Payment or tender is to be made as follows: __________
The Tenant is advised to obtain and preserve a written receipt or a
bank transaction record, and to identify the premises and the months
to which the payment relates. If the Tenant contends that payment or
tender within the two months has been prevented by any act or
omission of the Landlord, the Tenant should record that contention in
writing to the Landlord immediately and not after the period has run.

  1. WHAT WILL FOLLOW IF THE TENANT DOES NOT PAY.

If the Tenant fails to pay or tender the whole of the said sum within
the said period of two months, the Landlord will, without further
notice to the Tenant, apply for recovery of possession of the
premises on the ground specified in section 20(2)(a) of the Punjab
Rent Act, 1995, by an application in the Form specified in Schedule
XII to that Act, presented to the Rent Authority having jurisdiction
over the premises at __________, Punjab. Since the Punjab Rent
(Amendment) Act, 2014, notified on 29 August 2014, the Rent Authority
under section 36(1) is the Subordinate Judge 1st Class, and in
practice that application is filed and heard in the court of the Rent
Controller-cum-Civil Judge (Junior Division) at the District Courts —
the same judicial officer and the same registry, whichever label the
cause title bears. The Tenant is expressly put on notice that the
procedure on such an application is the summary procedure under
section 38 of the Act: the Tenant will be summoned and will be
required to obtain LEAVE TO CONTEST, and an application for leave
must be made within the period allowed by the Act and the summons,
failing which the Landlord's averments may be taken as admitted and
an order for eviction may follow without a trial. In that application
the Landlord will also claim the arrears, the other charges, interest
and the costs of the proceedings.

  1. THIS INDULGENCE IS AVAILABLE TO THE TENANT ONCE ONLY.

The benefit of the two-month period given by this notice is available
to a tenant only once in respect of the same premises. If the Tenant
pays within the two months and thereafter again falls into arrears of
three or more consecutive months, the Landlord will be entitled to
apply for eviction without extending that indulgence a second time.

  1. NO WAIVER, AND NOTHING GIVEN UP.

Nothing in this notice, and no acceptance by the Landlord of any sum
paid or tendered by the Tenant, shall operate as a waiver of any
breach of the tenancy by the Tenant, as the creation of a new
tenancy, as an admission of any fact asserted by the Tenant, or as an
abandonment of any other ground of eviction available to the Landlord
under section 20 of the Punjab Rent Act, 1995 or of any right or
remedy the Landlord may have in law or in equity. All such rights and
remedies are expressly reserved.

  1. SERVICE OF THIS NOTICE.

This notice is served on the Tenant __________, being service
in the manner provided by section 106 of the Transfer of Property
Act, 1882 as required by section 20(2)(a) of the Punjab Rent Act,
1995. Refusal by the Tenant to accept the notice, or its return
unclaimed, will be treated as good service.
