PARKING SPACE RENT AGREEMENT
This Agreement is made at __________ on __________.
BETWEEN
__________, of __________, phone __________ (the "Owner");
AND
__________, of __________, phone __________ (the "Renter").
The Owner and the Renter are each a "Party" and together the "Parties".
RECITALS
A. The Owner is __________, in respect of the parking space described in the Schedule to this Agreement.
B. The Owner has agreed to let the Renter use that parking space for the Renter's vehicle, described below, on the terms of this Agreement.
NOW THIS AGREEMENT WITNESSES as follows.
- NATURE OF THE ARRANGEMENT
1.1 This Agreement is __________.
- THE VEHICLE
2.1 The parking space may be used only for the Renter's __________ bearing registration number __________. If the Renter wishes to park a different vehicle, the Parties shall record that change in writing before it happens.
- TERM
3.1 This arrangement begins on __________ and is __________.
- RENT AND DEPOSIT
4.1 The Renter shall pay the Owner a monthly rent of __________, payable on or before day __________ of each calendar month.
4.3 Maintenance charges levied by a society or association on the parking space, if any, are __________.
- USE AND RESTRICTIONS
5.1 The Renter shall use the parking space only to park the vehicle named in clause 2, shall not use it for repair, washing on a commercial scale, or storage of any goods, and shall not sub-let, share or permit any other person's vehicle to use it.
5.3 The Renter shall comply with any reasonable rule of the building, society or association applicable to the parking area, notified to the Renter in writing.
- LIABILITY
6.1 The vehicle is parked at the Renter's own risk. The Owner is not liable for theft of, or damage to, the vehicle or anything in it, except to the extent caused by the Owner's own negligence or wilful act. The Renter is responsible for maintaining any insurance on the vehicle the Renter considers necessary.
6.2 The Renter shall be liable for damage the Renter's vehicle or its use causes to the parking space or to the building's common areas, fair wear and tear excepted.
- ENDING THE ARRANGEMENT
7.1 Either Party may end this arrangement by giving the other __________ days' written notice. On a month-to-month arrangement this notice may be given at any time; on a fixed term it takes effect only from the end of that term unless both Parties agree otherwise.
7.2 The Owner may end this arrangement immediately, without notice, if the Renter is more than thirty days in arrears of rent, or persistently breaches clause 5 after being asked in writing to stop.
7.3 On the arrangement ending, the Renter shall remove the vehicle and vacate the parking space, and the Owner shall refund any security deposit as clause 4.2 provides.
- GENERAL
8.1 This Agreement is the entire understanding between the Parties about the parking space and may be amended only in writing signed by both.
8.2 A dispute arising from this Agreement may be raised before the courts having jurisdiction at __________.
8.3 This Agreement is governed by the laws of India as in force in the State of Punjab or the Union Territory of Chandigarh, according to where the parking space is situated.
