TERMINATION OF AN AGENCY AGREEMENT

Parties

2. The Agent — __________, of __________, mobile __________, email __________ ("the Agent").

Background

A. By an agreement dated __________ ("the Agency Agreement"), the Owner appointed the Agent in connection with the property at __________, in __________: __________ ("the Property").

B. The Owner and the Agent have agreed to end that appointment on the terms below.

1. The appointment ends

1.1 The Agent's appointment ends on __________ ("the End Date"). From that date the Agent has no authority to market the Property, show it, negotiate for it, receive money for it, or act for the Owner in any other way.

2. Commission earned before the End Date

2.1 No other commission has been earned, and none is payable except under clause 3.

3. Introductions made before the End Date

3.1 An introduction the Agent made earns commission after the End Date only if the person introduced is named in this clause.

4. Keys, advertisements and third parties

4.1 Within 7 days after the End Date, the Agent will return every key, access device and document of the Owner's, remove every signboard, withdraw every advertisement of the Property it placed or caused to be placed, and confirm in writing that it has done so.

4.2 The Agent will tell every person to whom it has shown or offered the Property, and every agent with whom it shared the listing, that it no longer acts for the Owner. Until a third party knows that the appointment has ended, that party may still be entitled to treat the Agent as acting for the Owner.

5. Confidentiality

5.1 After the End Date the Agent will not use any information about the Owner, the Property or any offer for any purpose.

6. Settlement

6.1 Apart from clauses 1.2, 2 and 3, neither party has any further claim against the other under the Agency Agreement.

6.2 This does not release either party from liability for fraud, or the Agent from accounting for any money of the Owner's it holds.

7. General

7.1 This agreement is governed by the law in force in __________, and only the courts having jurisdiction where the Property is situated may decide a dispute about it.

7.2 A notice under this agreement is given in writing, by hand or by email, to the address given for the other party above.

Personal data

This notice is given under the Digital Personal Data Protection Act, 2023.

The names, addresses, telephone numbers and email addresses in this document are collected for one purpose: ending the appointment of the Agent and settling what survives it. The Owner and the Agent each keep a copy of this record. It may be shown only to the parties, and a person named in clause 3 if a commission claim concerns them, and it will not be used for marketing.

If the engagement does not go ahead, the personal data in this document is kept for 90 days from that decision and then erased. If it goes ahead, this record is kept for the term of the engagement plus 12 months and then erased, unless a law requires a particular record to be kept longer.

Consent to the use of personal data in this document may be withdrawn at any time by writing to __________. A request to correct inaccurate data, to erase data once its purpose has ended, or to complain about how it has been handled may be sent to the same address, and will be answered within 30 days.

This document does not collect any Aadhaar number, PAN, bank-account detail or copy of an identity document; the persons named in clause 3 are named only so that the protection is certain.
