Transport / Freight Contract

Answer what you can. The draft beside these boxes is rewritten as you go, so you can see exactly what each answer does to the document.

What you type stays in this browser. Moving to a new step asks this site to draw it, but nothing is kept anywhere until you choose to keep a copy — and closing this tab loses it.

The live draft

The draft, as it stands

This is the document as far as you have reached, not the whole of it yet — the rest appears as you answer more questions. It is rewritten every time you change an answer.

A long blank line — __________ — stands wherever an answer has not been given. It is left that visible on purpose, so an unfinished document cannot be mistaken for a finished one.

No answer has been given, so every place a detail belongs is standing blank. The shape of the document is worth reading even now.

TRANSPORT / FREIGHT CONTRACT

BETWEEN

__________, of __________, acting through __________ (the "Consignor");

AND

__________, of __________, PAN __________, acting through __________ (the "Transporter").

  1. 1. THE CARRIAGE

1.3 The Consignor will ask for a truck for each load by phone, email or message, stating the route, the Goods, the weight and the loading time. The Transporter shall supply a roadworthy, covered or suitable truck of the capacity asked for, with a valid registration, fitness, insurance, permit and a licensed driver, at the place and time stated. The Transporter may decline a single request if it cannot supply a truck, but shall say so at once.

1.4 The Transporter shall issue a consignment note (lorry receipt) for every load, signed by the driver or its agent, showing the Goods, the number of packages, the weight, the declared value, the truck number, the places of dispatch and delivery, and the consignee. The Consignor shall give the Transporter true particulars of the Goods and shall declare their value in writing for each load.

1.5 The Consignor shall give each truck the invoice, e-way bill and other papers the tax and transport laws require for the movement. The Transporter shall make sure they travel with the truck, shall not carry Goods without them, and shall carry no unlawful, hazardous or prohibited goods in the same truck.

  1. 2. FREIGHT AND PAYMENT

2.3 GST on the freight is dealt with as the law requires, whether charged by the Transporter or paid by the Consignor under reverse charge, and the Parties shall each give the other the details and papers needed. Where the law requires tax to be deducted at source from the freight, the Consignor shall deduct it and give the certificate for it.

  1. 3. TIME, CARE AND RISK

3.2 The Transporter shall take reasonable care of the Goods from the time it takes them until it delivers them, shall not transfer them to another truck or sub-contract the carriage without telling the Consignor, shall keep them covered and protected, and shall not stop the truck with the Goods in an unsafe place or let anyone other than the driver and helper travel in it.

3.3 The Transporter is responsible for loss of, damage to or delay in delivery of the Goods while in its care, except where it proves the cause was the Consignor's fault or wrong particulars, the nature or packing of the Goods, an act of God, or another cause for which the law does not make a carrier answerable. Its liability for any one load shall not exceed the value of that load declared in the consignment note, and where no value was declared, the limit the law on carriage by road sets applies. The Consignor shall give written notice of a claim, with the consignment note and proof of loss, within a reasonable time of delivery or of the date delivery was due.

3.5 The Transporter shall obey traffic, axle-load and permit rules, is responsible for fines for its own breach of them, and for the driver's and helper's wages and conduct. The Consignor is not liable for the driver's or helper's acts or for accidents on the road.

3.6 The Transporter shall not keep the Goods against any claim it has against the Consignor, except as the law allows a carrier, and shall return or deliver them as the Consignor directs.

Reading costs nothing. Keeping a copy needs an account.

The opening of the draft is on this page as you answer it. Once every answer is in, the button below opens the whole draft, watermarked — still without an account. Printing it, or keeping a clean copy, is where an account is asked for. That is the whole arrangement.

A kept copy has to belong to somebody, and that is the reason for the account. There is nothing further to it.
