When a lender renews or varies a credit facility, the guarantor/security provider confirms whether existing security continues. Drafted carefully: s.133, Contract Act can discharge a surety over an unconsented variance; ss.130-131 govern revoking a continuing guarantee. A blanket “continues regardless” clause can hide a real variation — state the original security, the exact change, limited consent, any revised cap/period, and rights preserved. A new facility needs its own instrument.

ਹੇਠਾਂ ਜੋ ਲਿਖਿਆ ਹੈ ਉਹ ਪੰਜਾਬ ਅਤੇ ਚੰਡੀਗੜ੍ਹ ਲਈ ਹੈ। ਇਸ ਵਿੱਚ ਉੱਥੋਂ ਦੀ ਹੀ ਸਥਿਤੀ ਦਿੱਤੀ ਗਈ ਹੈ, ਇਹ ਨਹੀਂ ਕਿ ਇਹ ਕਿੱਥੇ-ਕਿੱਥੇ ਕਿਵੇਂ ਬਦਲਦੀ ਹੈ — ਭਾਵ ਹੇਠਲੀਆਂ ਰਕਮਾਂ ਉਹੀ ਹਨ ਜੋ ਲਾਗੂ ਹੁੰਦੀਆਂ ਹਨ। ਦਰਾਂ ਬਦਲਦੀਆਂ ਰਹਿੰਦੀਆਂ ਹਨ, ਇਸ ਲਈ ਸਬ-ਰਜਿਸਟਰਾਰ ਦਫ਼ਤਰ ਤੋਂ ਪੱਕਾ ਕਰ ਲੈਣਾ ਠੀਕ ਰਹਿੰਦਾ ਹੈ। ਜੇ ਪ੍ਰਾਪਰਟੀ ਭਾਰਤ ਵਿੱਚ ਕਿਤੇ ਹੋਰ ਹੈ, ਤਾਂ ਇਸ ਵਿੱਚੋਂ ਕੁਝ ਵੀ ਤੁਹਾਡੇ ਲਈ ਨਹੀਂ ਹੈ।

ਕੋਈ ਸਥਿਰ ਸਥਿਤੀ ਨਹੀਂ: ਉਹੀ ਸਹੂਲਤ = ਕੋਈ ਨਵਾਂ ਹੱਕ ਨਹੀਂ; ਵੱਡੀ ਅਗਾਊਂ ਰਾਸ਼ੀ ਨੂੰ ਵਾਧੂ ਭਾਰ (further charge) ਵਜੋਂ ਪ੍ਰਭਾਰਿਤ ਕੀਤਾ ਜਾ ਸਕਦਾ ਹੈ। ਦਸਤਖ਼ਤ ਕਰਨ ਤੋਂ ਪਹਿਲਾਂ ਸਬ-ਰਜਿਸਟਰਾਰ ਤੋਂ ਜਾਂ ਧਾਰਾ 31 ਹੇਠ ਨਿਰਣੇ ਰਾਹੀਂ ਅੰਕੜਾ ਲਵੋ — ਘੱਟ-ਸਟੈਂਪ ਹੋਣ ਉੱਤੇ, ਕਮੀ ਅਤੇ ਜੁਰਮਾਨੇ ਦਾ ਭੁਗਤਾਨ ਹੋਣ ਤੱਕ ਅਸਵੀਕਾਰਯੋਗ (ਧਾਰਾ 35)।

ਰਜਿਸਟਰੀ

ਰਜਿਸਟਰ-ਯੋਗ ਨਹੀਂ (ਧਾਰਾ 17) — ਕੋਈ ਜਾਇਦਾਦ ਹਿੱਤ ਸਿਰਜਿਆ ਨਹੀਂ ਜਾਂਦਾ। ਜਾਇਦਾਦ ਨੂੰ ਵੀ ਭਾਰਗ੍ਰਸਤ ਕਰਨ ਨਾਲ ਇਹ ਬੰਧਕ ਬਣ ਜਾਂਦਾ ਹੈ: ਰਜਿਸਟਰਡ, ਦੋ ਗਵਾਹ (ਧਾਰਾ 59, ਜਾਇਦਾਦ ਤਬਾਦਲਾ ਐਕਟ, 1882), ਜਦ ਤੱਕ ਇਹ ਸਵਤਵ-ਦਸਤਾਵੇਜ਼ਾਂ ਦੇ ਨਿਕਸ਼ੇਪ ਰਾਹੀਂ ਨਾ ਹੋਵੇ।
