When you need it

When a lender renews or varies a credit facility, the guarantor/security provider confirms whether existing security continues. Drafted carefully: s.133, Contract Act can discharge a surety over an unconsented variance; ss.130-131 govern revoking a continuing guarantee. A blanket “continues regardless” clause can hide a real variation — state the original security, the exact change, limited consent, any revised cap/period, and rights preserved. A new facility needs its own instrument.

It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. No settled position: same facility = no new right; a larger advance can be charged as a further charge. Get the figure from the Sub-Registrar or s.31 adjudication before signing — under-stamped, inadmissible until the deficiency and penalty are paid (s.35).

Not registrable (s.17) — no property interest created. Charging property too makes it a mortgage: registered, two witnesses (s.59, TPA 1882), unless by deposit of title deeds.
