D. The RBI directions on release of documents

  1. The release of these documents is governed by Reserve Bank of India circular DOR.MCS.REC.38/01.01.001/2023-24 dated 13 September 2023, Responsible Lending Conduct – Release of Movable / Immovable Property Documents on Repayment/Settlement of Personal Loans, which applies where the release fell due on or after 1 December 2023. Under that circular you were required to release all original documents and to remove any charge registered with any registry within 30 days of full repayment or settlement; where a delay beyond that period is attributable to you, you are required to compensate me at the rate of ₹5,000 for each day of delay; and where original documents are lost or damaged, you are required to assist me in obtaining duplicate or certified copies and to bear the cost.

E. What is still outstanding

  1. Handing back the papers is only part of the job. Please confirm to me in writing, within 15 days of this letter:

(a) that the satisfaction of the security interest created over the Property has been filed with the Central Registry of Securitisation Asset Reconstruction and Security Interest of India (CERSAI), and give me the acknowledgement or Security Interest ID showing the satisfaction. This is not a courtesy I am requesting: section 25 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 requires you, on payment or satisfaction in full of a security interest, to give intimation of that satisfaction to the Central Registry within thirty days of the payment or satisfaction, and the circular referred to in paragraph 8 above requires the charge to be removed within the same 30 days;

(b) if the mortgage, or any notice, intimation or memorandum of it, was filed or registered with a Sub-Registrar, what your office has done or will do to have the discharge recorded, and by when. I understand that under section 60 of the Transfer of Property Act, 1882, where a mortgage has been effected by a registered instrument I may require you to execute and have registered an acknowledgement in writing that your interest has been extinguished, and that the cost of doing so falls on me. I am willing to bear that cost and ask you to make an authorised officer available for execution and registration at a mutually convenient date;

(c) that all standing instructions, NACH and ECS mandates and post-dated cheques given in connection with this loan have been cancelled; and that any undated or security cheques, blank signed forms, blank signed stamp papers or signed undertakings taken at the time of sanction have been returned to me or destroyed — please state which, and for anything destroyed, please confirm the date and the officer who authorised it.

  1. No Dues Certificate. The position on the No Dues / No Objection Certificate for this account is: __________. Where it is still to be issued, please issue it within 15 days of this letter and email a scanned copy to __________, with the signed original available for collection at the branch.
  1. Credit records. Please ensure that Loan Account No. __________ is reported as "Closed" with nil outstanding to all Credit Information Companies — TransUnion CIBIL, Experian, Equifax and CRIF High Mark — in your next reporting cycle. If my credit report continues to show this account as live or outstanding, I will take it up as a credit information complaint, relying on the Reserve Bank of India's Framework for compensation to customers for delayed updation/rectification of credit information dated 26 October 2023 (DoR.FIN.REC.48/20.16.003/2023-24), which provides for compensation to the complainant where such a complaint is not resolved within 30 days.

F. If I do not hear from you

  1. If the confirmations asked for above do not reach me within the periods stated, I will escalate, and I am giving you notice of that now:

  1. Do not sign the bank's slip first. Most branches produce a one-line printed acknowledgement saying all documents were received in original and in good condition. If you sign that before checking, you have already given away the argument. Ask to check the bundle first. Then, before you sign their slip, write on the slip itself, immediately above your signature: "Subject to my letter dated ____________ handed over herewith." That single line on their own paper is worth far more than paragraph 14 of this letter, because paragraph 14 is only your assertion, while an annotated slip is the document the bank itself is relying on. Sign both — their annotated slip and this letter.
  1. Ask for the List of Documents (LOD). It is the list made when the loan was disbursed of every paper you deposited. Tick your bundle against it line by line. If the branch says it is not traceable, that itself is worth recording — use the field provided.
  1. Count pages. A sale deed with three pages quietly missing looks complete in a folder. Page counts in the Schedule are the cheapest protection in this document.
  1. Original or copy. Certified copies and photocopies feel like documents at a counter. Mark each line honestly. A purchaser's advocate will spot it in five minutes and it will cost you far more then.
  1. Photograph every document listed in the Schedule before you leave the counter, with the branch visible in at least one frame. Date-stamped photographs are the cheapest record of condition there is.
  1. Check which regulator covers your lender. Banks and non-banking financial companies end at the RBI Ombudsman under RB-IOS 2026, and the window there is short — 90 days from the end of the 30 days you gave the lender, or from its last letter to you, whichever is later. Housing finance companies are outside that scheme altogether and go to the National Housing Bank instead. The letter picks the right route from your answer in the form, but diarise the deadline the day you send it.
  1. Two more things to chase after today: the CERSAI satisfaction (ask for the Security Interest ID and check it yourself at the CERSAI public search), and, if your mortgage was created or intimated by a registered document, the discharge entry at the Sub-Registrar's office. The papers being in your cupboard does not by itself clear the record.
