Why you need it

When you need it

For the day you collect original property papers from the bank/HFC after loan closure — sign this instead of the bank's own one-line printed slip. Why it matters: the slip usually just says 'received all documents in original and good condition'; signing it says the bundle was complete, and going behind your own clean signature later is slow and expensive. This instead lists every document, page counts and original/copy status, and reserves your rights on anything not in the bundle. Before signing, get the List of Documents or Memorandum of Deposit from sanction and tick the bundle against it; if refused, say so in the letter and sign only against your own records. Also claims RBI delay compensation if papers came late, asks for CERSAI satisfaction, the No Dues Certificate and a credit-bureau update, and sets an escalation ladder — banks/NBFCs to the RBI Ombudsman, HFCs to the National Housing Bank. Don't use this if: collecting as a legal heir or under a power of attorney; the borrower is a company/LLP/partnership; the loan is still running; or you want to discharge a registered mortgage. Not a substitute for a No Dues Certificate.

What follows is the position for this kind of document. The amount is set by the state the property is in and it changes, so the figure for your own state is worth confirming at the sub-registrar’s office before you pay anything.

Stamp duty

None — no stamp paper, e-stamp or franking; plain paper. Records a handover, not a transfer or money receipt. A counter may want a ₹1 revenue stamp (Article 53), but likely doesn't apply — s.2(23)(b)'s 'receipt' means property received in satisfaction of a debt, and returned deeds are the opposite. Even if it applied, ₹1 is the entire liability everywhere (Entry 91, List I). Affix one if it helps; nothing more can be demanded.

Registration

Not registrable — s.17(1) catches instruments creating/extinguishing a ₹100+ right; a receipt does neither. Separately, if secured by a registered deed, s.60, TPA 1882 lets you demand a registered extinguishment acknowledgment. CERSAI satisfaction is the lender's own filing; paragraph 9 asks for proof.

Notarisation

Not required — the bank's own hand (officer's signature, name, code, date, branch stamp) is the strongest proof. If refused, email the branch and send registered post with acknowledgement due.

Witnesses

None required. If anything is missing or a photocopy, have someone sign the optional 'present at handover' line, and photograph every document before leaving.

  1. The security for that loan was created over the following immovable property ("the Property") by way of deposit of title deeds:

It is not a confirmation that every document deposited with you has been returned, not a certificate that the documents are complete or free from defect, not a discharge of any claim I have or may have against you, and not a waiver of any right available to me under the loan documents, under the directions of the Reserve Bank of India, or under any law.

— No copy of the List of Documents or Memorandum of Deposit of Title Deeds was made available to me before I signed, although I asked for it at the counter. I have therefore signed on the strength of my own records alone. I reserve the right to raise a claim if any document deposited with you later turns out not to have been returned. Please issue me a copy of that list within 7 days of this letter.

— The following documents were deposited with you as security and have not been returned to me today. They remain in your custody and at your responsibility, and I expressly reserve all rights in respect of them:

  1. Original Sale Deed dated 03.02.2009 between Mr. S. R. Iyer and Kamat Developers Pvt. Ltd. (the link deed), registered at Sr. No. PVL-2/1173/2009
