Borewell Drilling Contract

Answer what you can. The draft beside these boxes is rewritten as you go, so you can see exactly what each answer does to the document.

What you type stays in this browser. Moving to a new step asks this site to draw it, but nothing is kept anywhere until you choose to keep a copy — and closing this tab loses it.

Your answers

Nothing answered yet. There are 5 questions on this form.

Still to answer

4 answers are still to come.

Nothing is amiss in what you have written. The document is simply not finished, and the draft marks each gap where an answer will go.

  1. The Owner and the Driller
  2. The site, depth and permission
  3. Rate, casing and payment
  4. Time and safety
  5. Signing

The live draft

The draft, as it stands

This is the document as far as you have reached, not the whole of it yet — the rest appears as you answer more questions. It is rewritten every time you change an answer.

A long blank line — __________ — stands wherever an answer has not been given. It is left that visible on purpose, so an unfinished document cannot be mistaken for a finished one.

No answer has been given, so every place a detail belongs is standing blank. The shape of the document is worth reading even now.

BOREWELL DRILLING CONTRACT

BETWEEN

__________, resident of __________ ("the Owner", which expression shall include the Owner's heirs, legal representatives and assigns), of the ONE PART;

AND

__________, of __________ ("the Contractor", which expression shall include the Contractor's partners, legal representatives and permitted assigns), of the OTHER PART.

The Owner and the Contractor are together "the Parties".

1. THE SITE AND THE WORK

1.4 The Owner shall point out the location, give the Contractor access for the rig and tell the Contractor of any buried pipe, cable, tank, septic tank, foundation or boundary that the drilling could affect. The Contractor shall take reasonable care to avoid damage to them.

2. PERMISSION

3. DRILLING, DEPTH AND CASING

3.4 The depth drilled and the length of casing used shall be measured jointly by the Owner (or the Owner's representative) and the Contractor, and recorded and signed by both when the bore is completed.

3.5 The Contractor shall keep a bore log recording, as drilled, the depth, the soil and rock layers met, the depth at which water was struck, the estimated yield if tested, and the casing installed, and shall give a copy to the Owner on completion.

4. PRICE AND PAYMENT

5. IF NO WATER IS FOUND

6. SAFETY AND MAKING THE BORE SAFE

6.1 The Contractor shall not leave any bore open or uncovered at any time. On completion, a bore that is to be used shall be securely capped, and a bore that is dry or abandoned shall be filled or closed safely, in the way the law requires, so that no person or animal can fall into it.

6.3 The Contractor is solely responsible for the safety of its workmen and rig and for compliance with applicable labour law in respect of their wages, provident fund, employees' state insurance and any welfare cess, and shall keep the Owner indemnified against any claim arising from the Contractor's failure to do so.

7. TERMINATION

7.1 Either Party may terminate this Contract on a material breach by the other that remains uncured for fifteen days after written notice, without prejudice to any amount already due.

8. DISPUTE RESOLUTION

9. GENERAL

9.1 This Contract, together with any drawing, specification or schedule attached, is the entire agreement between the Parties on the Work and supersedes any earlier discussion.

Reading costs nothing. Keeping a copy needs an account.

The opening of the draft is on this page as you answer it. Once every answer is in, the button below opens the whole draft, watermarked — still without an account. Printing it, or keeping a clean copy, is where an account is asked for. That is the whole arrangement.

A kept copy has to belong to somebody, and that is the reason for the account. There is nothing further to it.
