HOUSE CONSTRUCTION CONTRACT

BETWEEN

__________, resident of __________ ("the Owner", which expression shall include the Owner's heirs, legal representatives and assigns), of the ONE PART;

AND

__________, of __________ ("the Contractor", which expression shall include the Contractor's partners, legal representatives and permitted assigns), of the OTHER PART.

The Owner and the Contractor are together "the Parties".

1. THE SITE AND THE WORK

1.5 All materials shall conform to the specifications agreed and, where applicable, to the standards prescribed by the Bureau of Indian Standards. The Owner or the Owner's representative may inspect materials and workmanship at any reasonable time before they are built into the Work.

5.3 The Contractor shall carry out the Work strictly in accordance with the sanctioned plan and shall make no deviation without the Owner's prior written consent and, where required, a revised sanction.

6. INSURANCE, SAFETY AND LABOUR

6.2 The Contractor is solely responsible for the safety of its workmen and for compliance with applicable labour law in respect of their wages, provident fund, employees' state insurance and any welfare cess, and shall keep the Owner indemnified against any claim arising from the Contractor's failure to do so.

7. TERMINATION

7.1 Either Party may terminate this Contract on a material breach by the other that remains uncured for fifteen days after written notice, without prejudice to any amount already due.

8. DISPUTE RESOLUTION

9. GENERAL

9.1 This Contract, together with the sanctioned plan and any drawing, specification or bill of quantities attached, is the entire agreement between the Parties on the Work and supersedes any earlier discussion.
