MODEL BYE-LAWS OF A RESIDENTS' WELFARE ASSOCIATION
__________
Adopted by the general body of members on __________.
- 1. NAME, OFFICE AND AREA
The name of the Association is __________ (the "Association"). Its office is at __________. It works for the residents of __________ (the "Area").
- 2. NATURE OF THE ASSOCIATION
The Association is __________. It is not run for profit, and no part of its income or property is paid or handed to any member.
- 3. OBJECTS
The objects of the Association are: (a) to look after the common areas, services and security of the Area; (b) to collect and spend maintenance charges for them; (c) to promote harmony and welfare among the residents; (d) to represent the residents before the authorities, the builder and others; and (e) to do whatever else helps these objects.
- 5. END OF MEMBERSHIP
Membership ends when a member ceases to own the unit, resigns in writing or dies. The person who succeeds to the unit may apply for membership. The general body may remove a member for a serious and continuing breach of these bye-laws, but only after giving the member a chance to be heard and only as the law allows.
- 10. FUNDS, ACCOUNTS AND AUDIT
The Association's funds are the maintenance charges and subscriptions the general body fixes, donations and interest. They are kept in a bank account in the Association's name, operated by any two of the President, the Secretary and the Treasurer. The financial year runs from 1 April to 31 March. The accounts are audited every year by an auditor the general body appoints, and the audited accounts are placed before the general body. A repair or sinking fund is built up as the general body decides.
- 11. ARREARS
A member who does not pay a charge on time is sent a written reminder and a notice. Interest, and any other step for recovery, may be taken only if the general body has approved it and the law allows it, and never before the member has been given a chance to explain.
- 12. COMMON AREAS AND RULES
Members and residents may use the common areas freely and without blocking them. No one may take over a common area or change it without the committee's written consent. The committee may make house rules for the use of the common areas, and they bind everyone once put up on the notice board. Before any action for breaking a rule, the committee gives the member a written notice and a chance to explain.
- 13. RECORDS
The Association keeps a register of members, the minute books, the accounts and the vouchers at its office. A member may inspect them during office hours on reasonable notice.
- 14. DISPUTES
A dispute between members, or between a member and the Association, about these bye-laws is first put to the managing committee, which tries to settle it. If it is not settled, it goes to the forum the law provides.
These bye-laws were adopted by the general body of members on the date written at the top.
