6.2 I request that a no-dues position as on __________ be confirmed to me in writing before the transfer is given effect, and that the consumption up to the reading on that date be billed to the outgoing consumer and not to me.
6.3 I am aware that under Section 56(2) of the Electricity Act, 2003 no sum due on account of electricity supplied is recoverable after two years from the date when it first became due, unless it has been shown continuously as recoverable arrears. I am also aware that where the Supply Code or the terms of supply so provide, a distribution licensee may require the clearance of past dues of the premises as a condition of transfer. I do not by this application admit any liability for arrears of any period before __________, and I request that if any such arrears exist, they be quantified and communicated to me in writing before this application is decided, so that I may take up the matter with the outgoing consumer.
- SECURITY DEPOSIT
7.1 I understand that the security deposit under Section 47 of the Electricity Act, 2003 is held against the consumer of record and not against the premises, and that on a change of name the usual course is that the outgoing consumer's deposit is refunded to that consumer, with interest at not less than the bank rate as Section 47(4) requires, after the final bill is adjusted, and that the incoming consumer furnishes fresh security calculated on the sanctioned load and the average billing of the connection.
7.4 I am ready to pay the prescribed application or processing fee for change of name, together with any additional security deposit assessed on the annual review of my consumption, and I request that the demand for these be raised in writing so that I may pay it at once.
DECLARATION AND UNDERTAKING

(a) the particulars given above are true to the best of my knowledge and belief, and nothing material has been concealed;

FIRST, GET YOUR DISCOM'S OWN FORM. This letter is a covering application. Your discom almost certainly has its own prescribed change-of-name / A&A form as well. Get that form, fill it, and file this letter on top of it — a plain-paper letter on its own is usually handed back. BSES Rajdhani, BSES Yamuna and Tata Power-DDL in Delhi, the UPPCL vitran nigams, MSEDCL, BESCOM and DHBVN/UHBVN all run a prescribed form or its online equivalent.
WHICH STATES THIS WAS DRAFTED FOR. The structure, the enclosure list and the security-deposit treatment were drafted against the supply codes and counter practice of Delhi, Uttar Pradesh, Maharashtra, Haryana, Karnataka and Rajasthan. The Electricity Act, 2003 framework is national and the paragraph structure will hold anywhere, but in any other state or union territory read this alongside your own discom's printed form and reconcile the enclosure list, the officer's designation and the fee before you file. BEST, in south Mumbai, runs its own rules.
WHERE TO FILE. At the divisional, sub-divisional or district office of __________ that has jurisdiction over your meter — the one printed on your bill, not the head office. Most discoms in Delhi, Maharashtra, Karnataka and Rajasthan also accept the same application through their consumer portal or mobile app, with scanned enclosures; the physical originals are then verified once. Filing online is faster and gives you an automatic docket number.
WHAT IT COSTS. Three separate amounts, and only the first is small:
- The change-of-name or processing fee. A few hundred rupees for a domestic connection in most states, higher for commercial and industrial categories. It is fixed by your state commission's schedule of charges, so ask for the current figure and insist on a receipt.
- Fresh security deposit, if the outgoing consumer's deposit is not transferred to you. This is calculated on your sanctioned load and average billing and is the real cost of a name change — it can run to several thousand rupees on a 3 kW domestic connection and much more on a commercial one. It is refundable, and it earns interest at not less than the bank rate under Section 47(4).
- Arrears, if any are found. Clear these with the outgoing consumer before you file, not after.
The stamp paper for the indemnity bond and the affidavit, and the notary's fee, add up to a few hundred rupees more.
HOW LONG. The Standards of Performance notified by your state regulatory commission set the outer limit, and it typically falls between seven and thirty days from a complete application. Delhi discoms usually turn a clean, NOC-backed domestic name change around in about a week. UPPCL divisions and MSEDCL sub-divisions commonly take longer, and a varasat case or one without an NOC takes longer still because it goes past a second desk. The clock only starts when the application is complete — an application returned for a missing enclosure resets it.
WHAT YOU SHOULD GET BACK. Three things, and you should chase all three:
- A dated acknowledgement with a service request or CRN number, at the counter, on the day you file. Do not leave without it. If you filed online, screenshot the docket.
- Written confirmation of the no-dues position and the security deposit position.
- The next bill, printed in your name. That bill IS the order — most discoms do not issue a separate transfer letter. Check the consumer name, the address, the sanctioned load, the category and the security deposit figure on it. If any of them is wrong, raise it immediately, while the file is still open.
IF NOTHING HAPPENS. Send a written reminder quoting the CRN. If the discom still does not act within the notified period, or refuses without reasons in writing, the remedy is a complaint to the discom's Consumer Grievance Redressal Forum (CGRF), which is free and takes no lawyer. If the CGRF's order does not satisfy you, appeal to the Electricity Ombudsman of your state commission. A civil suit is slow and usually unnecessary here — the CGRF and Ombudsman route is free and faster. Going that route does not shut the door on a consumer complaint either: the remedy under the Consumer Protection Act is an additional one and is not taken away by the CGRF or the Ombudsman.
TWO THINGS THAT CATCH PEOPLE OUT.
First, arrears of the previous consumer. Electricity dues are not a charge on the property, but where the state Supply Code or the terms of supply say so, a discom can insist that past dues of the premises be cleared before it gives you a connection or transfers one. That is why paragraph 6 asks for the arrears position in writing BEFORE the transfer, rather than after. Get a no-dues certificate as part of your purchase, not as an afterthought.
Second, the security deposit. It belongs to the person named on the account, not to the flat. If you do not get the seller's written consent to transfer it, they get it back and you pay fresh. Ask for that consent at the registration table, along with the last paid bill and the meter reading photograph. It costs the seller nothing and saves you a real amount of money.
