The nakal jamabandi (fard) for the said year, obtained from the record, is filed with this application, and the entry complained of is marked upon it.

4. The material on which the correction is sought

Production of originals. The applicant will produce the originals of every document relied upon before the Halqa Patwari, before the Field Kanungo and before this Office as and when required, and will attend on any date that may be fixed.

5. This is a correction of the record and not a claim of title

5.1 The applicant does not by this application seek any mutation. Paragraph 7.30 of the Punjab Land Records Manual forbids a mutation being entered or sanctioned in order to correct an entry already incorporated in a jamabandi, and the applicant is accordingly before this Office under the fard badar procedure of paragraph 7.29 and not by way of intkal. Nothing in this application invokes section 34 of the Punjab Land Revenue Act, 1887, which governs the reporting of acquisitions of interest, their entry in the register of mutations and the Revenue Officer's inquiry into and attestation of those entries.

5.2 The applicant does not by this application seek any declaration of title, nor the creation, transfer, limitation, extension or extinguishment of any right in the said land. By section 44 of the Punjab Land Revenue Act, 1887 an entry in a record-of-rights or in an annual record is presumed to be true only until the contrary is proved or a new entry is lawfully substituted for it, and by section 45 a person disputing the correctness of an entry as a matter of title is left to his suit for a declaratory decree. Nothing sought here trespasses upon that.

5.3 Sections 31 and 33 of the Punjab Land Revenue Act, 1887 provide for the record-of-rights of an estate and for the annual record — the jamabandi — which is prepared and maintained from it, and it is on the Revenue Officer that the duty of seeing that the record is correctly made and kept is placed. Section 37 of the same Act restricts the variation of entries as between one record and the next, and permits such variation, so far as is material here, by the making of entries in accordance with facts proved or admitted to have occurred and by the making of entries agreed to by all the parties interested or supported by a decree or order binding upon them. The correction is asked for on exactly that footing: it accords with the facts proved by the material described in clause 4 above, and it carries the record no further than that material already carries it.

5.4 The correction sought takes nothing from any person and gives nothing to the applicant that he does not already hold under the material described in clause 4. It makes the record say what the sanctioned papers already say.

6. The officer before whom this application lies

The rule under which the forum is chosen. Under paragraph 7.29 of the Punjab Land Records Manual, a fard badar relating only to entries made while preparing the current consigned jamabandi, having no bearing upon previous jamabandis, is disposed of by the Circle Revenue Officer; where the corrections extend to previous jamabandis, they are disposed of by the Sub-Divisional Magistrate concerned. This application is presented on that footing. If this Office is of the view that the application lies before the other officer, the applicant prays that it be transmitted to him rather than rejected, and the applicant will attend there.

7. Objections, consents and pending proceedings

Hearing. The applicant is aware that paragraph 7.29 of the Punjab Land Records Manual provides that it is not necessary to hear the parties concerned in connection with the disposal of fard badar entries. The applicant nevertheless undertakes to attend on any date this Office may fix, to produce the originals of every document relied upon, and has no objection whatsoever to notice being issued to any other person interested in the said khewat before the correction is ordered.

8. Prayer

It is therefore most respectfully prayed that the correction may be ordered as follows —

(a) that the Halqa Patwari of the revenue estate of Village __________ be directed to prepare a fard badar in the prescribed form, entering in columns 1 to 4 thereof the entry to be corrected, the entry as it stands, the entry as it should stand, and the reason for the correction;

(b) that the Field Kanungo (girdawar) be directed to examine the said entry against the parat sarkar, the misal haqiat, the register of mutations and the earlier jamabandis of the revenue estate, and to report in column 5;

(c) that it be ordered in column 6 that the jamabandi for the year __________ of the said revenue estate be corrected in __________ of Khewat No. __________ so as to read as set out in clause 3.2 above;

(d) that the correction so ordered be carried into the parat patwar and the parat sarkar, and into the next jamabandi prepared for the said revenue estate; and

(e) that such further or other order be made as may be thought fit in the circumstances.

9. Fees

The applicant undertakes to pay every fee lawfully chargeable, on demand, and to place the receipt on the file.

The scale the applicant has been able to find is the copying scale in paragraph 3.48 of the Punjab Land Records Manual, read with rule 71 of the Punjab Land Revenue Rules, as published and checked on 6 September 2026: a copy of a fard badar, of a jamabandi, of a pending mutation, of the counterfoils of mutation sheets and of the misal haqiat at Rs. 20 per page of the original document; a fard haqiat at Rs. 20 irrespective of the number of khewats; and tracing of a field map or a tatima shajra at Rs. 20 per four fields, those fees being credited to the head "0029 - Land Revenue - 800 - other Receipts - 07 - Copying and Inspection Fee of patwaris Record". The applicant does not assert that this scale is the current one, and will pay whatever this Office lawfully demands against a printed receipt.

A computerised nakal issued from a Fard Kendra or a Sewa Kendra is furnished under rule 71-B of the Punjab Land Revenue Rules, notified vide No. G.S.R/P.A/1887/Ss.155 and 156/Amd.2009 dated 28-05-2009, on the fee prescribed for it, which is not the rule 71 page rate set out above; the applicant will pay the prescribed rule 71-B fee against a printed receipt on being told what it is.

No mutation fee under section 38 of the Punjab Land Revenue Act, 1887 is payable upon a fard badar, no mutation being entered or attested.

ANNEXURE B — WORKING SHEET FOR THE HALQA PATWARI (NOT THE PRESCRIBED FORM)

This sheet is filled in by the applicant to save the Halqa Patwari's time. It is not the prescribed fard badar form and is not a substitute for it. Under paragraph 7.29 of the Punjab Land Records Manual the fard badar is prepared by the Halqa Patwari in the prescribed six-column form from the record itself: he fills columns 1 to 4, the Field Kanungo (girdawar) reports in column 5, and the revenue officer disposing of the fard badar orders in column 6. Everything set out below against columns 1 to 4 is as stated by the applicant and is subject to verification against the record. The column heads used here are inferred from the structure described in paragraph 7.29 and should be read against the printed proforma, which governs.
