District Amritsar, Punjab.
Through the Halqa Patwari, Patwar Circle Patwar Circle Landran, of the revenue estate of Village Badali Ala Singh.
Subject: Fard badar — correction of a misspelling of the name of a recorded owner appearing in the ownership column (khana malkiyat) of the jamabandi for the year 2021-2022, Khewat No. Khewat No. 412, Khatauni No. Khatauni No. 486, of the revenue estate of Village Badali Ala Singh, Hadbast No. Hadbast No. 213.
Online request already made (Request for Fardbadar, jamabandi.punjab.gov.in): X
Respected Sir / Madam,
I, X, son of Sardar Gurdial Singh, aged about 25,000 years, by occupation agriculturist, resident of X, mobile X, Aadhaar ending 4321, respectfully submit as follows.
I am the recorded owner (malik) whose name stands in the ownership column of the said khewat, and I am therefore a person interested in the entry to which this application relates.
Signed by an attorney. This application is signed and presented on behalf of the applicant by his attorney under registered SPA No. 1147 dated 12.03.2026, Sub-Registrar, Kharar. The original instrument is produced herewith for inspection and a copy is filed with this application.
Joint applicant. This application is made jointly with X, son of Sardar Gurdial Singh, who is likewise interested in the said khewat and who signs at the foot of this application.
The land is entered in the jamabandi for the year 2021-2022 of the revenue estate of Village Badali Ala Singh, Tehsil / Sub-Tehsil Kharar, District Amritsar, Punjab, as set out below.
| Particular | As it stands in the jamabandi |
|---|---|
| Revenue estate (mauza) | Badali Ala Singh |
| Hadbast number | Hadbast No. 213 |
| Patwar circle | Patwar Circle Landran |
| Khewat No. | Khewat No. 412 |
| Khatauni No. | Khatauni No. 486 |
| Khasra / Killa No(s). | Killa No. 21//14 (8-0), Killa No. 21//15 (7-12) |
| Total area | 15 kanal 12 marla |
| Share of the applicant as recorded | 1/6 share as recorded |
| Jamabandi year | 2021-2022 |
The nakal jamabandi (fard) for the said year, obtained from the record, is filed with this application, and the entry complained of is marked upon it.
3.1 The entry as it now stands. Ownership column of Khewat No. 412 reads: 'Gurmail Singh son of Gurdial Singh — 1/6 share'
3.2 The entry as it ought to read. Ownership column of Khewat No. 412 should read: 'Gurmel Singh son of Gurdial Singh — 1/4 share', as sanctioned by Mutation No. 3187
3.3 The nature of the error. The error is a misspelling of the name of a recorded owner, and it appears in the ownership column (khana malkiyat) of the said khewat.
3.4 How the error came about. Mutation No. 3187 sanctioned on 14.08.2019 gave the applicant a 1/4 share, but when the jamabandi for 2021-2022 was written up the share was copied from the earlier khewat instead of from the sanctioned mutation, and was entered as 1/6.
3.5 When it came to notice. The applicant first became aware of the error on or about 1 April 2026, and has come before this Office without avoidable delay since.
The document that proves the correct entry. Sanction order on Mutation (Intkal) No. 3187 of the revenue estate of Village Badali Ala Singh, which records the applicant's share as 1/4 and not 1/6. That document bears the date 2 April 2026, and a copy of it is filed with this application.
The sanctioned mutation. The correct position also appears from Mutation No. 3187 sanctioned on 14.08.2019, a copy of the sanction whereof is filed with this application. The entry now standing in the jamabandi does not agree with that sanction.
The registered instrument. The correct position also appears from Sale Deed No. 4521 dated 14.05.2019, Office of the Sub-Registrar, Kharar, a certified copy whereof is filed with this application.
The order or decree. The correct position also appears from Decree dated 02.02.2021 in Civil Suit No. 214 of 2019, Civil Judge (Junior Division), Kharar, a certified copy whereof is filed with this application.
Production of originals. The applicant will produce the originals of every document relied upon before the Halqa Patwari, before the Field Kanungo and before this Office as and when required, and will attend on any date that may be fixed.
5.1 The applicant does not by this application seek any mutation. Paragraph 7.30 of the Punjab Land Records Manual forbids a mutation being entered or sanctioned in order to correct an entry already incorporated in a jamabandi, and the applicant is accordingly before this Office under the fard badar procedure of paragraph 7.29 and not by way of intkal. Nothing in this application invokes section 34 of the Punjab Land Revenue Act, 1887, which governs the reporting of acquisitions of interest, their entry in the register of mutations and the Revenue Officer's inquiry into and attestation of those entries.
5.2 The applicant does not by this application seek any declaration of title, nor the creation, transfer, limitation, extension or extinguishment of any right in the said land. By section 44 of the Punjab Land Revenue Act, 1887 an entry in a record-of-rights or in an annual record is presumed to be true only until the contrary is proved or a new entry is lawfully substituted for it, and by section 45 a person disputing the correctness of an entry as a matter of title is left to his suit for a declaratory decree. Nothing sought here trespasses upon that.
5.3 Sections 31 and 33 of the Punjab Land Revenue Act, 1887 provide for the record-of-rights of an estate and for the annual record — the jamabandi — which is prepared and maintained from it, and it is on the Revenue Officer that the duty of seeing that the record is correctly made and kept is placed. Section 37 of the same Act restricts the variation of entries as between one record and the next, and permits such variation, so far as is material here, by the making of entries in accordance with facts proved or admitted to have occurred and by the making of entries agreed to by all the parties interested or supported by a decree or order binding upon them. The correction is asked for on exactly that footing: it accords with the facts proved by the material described in clause 4 above, and it carries the record no further than that material already carries it.
