4. The applicant's cultivation and possession

4.1 The applicant has been in cultivating possession of the said khasra numbers __________, and has himself sown, irrigated and harvested the crop of each such harvest and borne the cost of cultivation, the produce being dealt with according to the footing upon which he holds the land, which is stated in clause 4.2 below.

4.2 The applicant holds and cultivates the said land upon the footing of __________.

4.4 Under paragraphs 9.8 and 9.9 of the Punjab Land Records Manual the crops are to be entered in the khasra girdawari as the inspection proceeds, and changes in rights, rents and possession are to be recorded in the appropriate columns at the same time. The entry complained of does not record what was upon the land, and it does not record who was upon it.

5. The material relied upon

5.1 Documents. __________

5.2 Production of originals. The applicant will produce the originals of every document relied upon before the Halqa Patwari, before the Field Kanungo and before this Office as and when required, and will attend on any date that may be fixed.

6. This is a correction of the record of possession and not a decision of title

6.1 The applicant does not by this application seek any mutation. A mutation (intkal) under section 34 of the Punjab Land Revenue Act, 1887 is the instrument by which an acquisition of an interest by inheritance, purchase, mortgage or otherwise is brought upon the record, and nothing of that kind is asked for here. Nor does the applicant seek a fard badar under paragraph 7.29 of the Punjab Land Records Manual, which is the instrument for correcting a clerical error already carried into the jamabandi, and which paragraph 7.30 keeps distinct from the mutation machinery.

6.2 The applicant does not by this application seek any declaration of title, nor the creation, transfer, limitation, extension or extinguishment of any right in the said land. By section 44 of the Punjab Land Revenue Act, 1887 an entry in a record-of-rights or in an annual record is presumed to be true only until the contrary is proved or a new entry is lawfully substituted for it, and by section 45 a person who disputes the correctness of an entry as a matter of right is left to his suit for a declaratory decree, now under section 34 of the Specific Relief Act, 1963. Nothing sought here trespasses upon that.

6.3 Sections 31 and 33 of the Punjab Land Revenue Act, 1887 provide for the record-of-rights of an estate and for the annual record prepared and maintained from it, and place upon the Revenue Officer the duty of seeing that the record is correctly made and kept. Section 36 of the same Act empowers a Revenue Officer, where a dispute exists as to an entry, to ascertain by summary inquiry the person in possession and to enter that person, leaving the question of right to be determined by a competent court. It is upon that footing, and no wider, that the applicant comes before this Office.

6.4 The correction sought takes nothing from any person that is his and gives the applicant nothing that he does not already hold. It asks only that the record say what was in fact upon the land in the harvests named.

7. The period to which this application is confined

7.1 __________

7.2 The applicant is aware that paragraph 9.9(d) of the Punjab Land Records Manual provides that no correction of the khasra girdawari may be made after the kachha papers of the harvest have been drawn or corrected, and prays that this application be taken up and decided before the papers of the harvests named are drawn or corrected.

7.3 The applicant in any event confines this application to the harvests falling within the period relating to the current jamabandi of the said revenue estate, which is the jamabandi for the year __________, and asks for the correction of no entry of any earlier or consigned jamabandi.

7.4 Under paragraph 7.57 of the Punjab Land Records Manual the preparation of a new jamabandi is begun by the Halqa Patwari and the Field Kanungo in the cold weather, before the middle of January, when they visit the estate, inquire of the right-holders as to unrecorded changes, read out the existing entries and note changes in the remarks column; and under paragraph 7.56 mutations upon which final orders have been passed up to 15 June inclusive, or such later date as the Director, Land Records, Punjab may approve, are incorporated in the new jamabandi. If the wrong entry is left to stand, it will be carried into the cultivation column of the next jamabandi of the estate and will thereafter be very much harder to disturb.

8. Notice, hearing and spot inspection

8.1 The applicant asks that the other side be heard. The applicant is aware that under paragraph 9.9(f) of the Punjab Land Records Manual a Revenue Officer of the rank of a Naib-Tehsildar or above may order the correction of a wrong entry that has crept into the khasra girdawari only after giving to the parties concerned an opportunity of being heard. The applicant does not seek an order behind anybody's back, and prays that notice issue to every person concerned before any correction is ordered.

8.4 Spot inspection. __________

8.7 Record to be produced. The applicant prays that the Halqa Patwari be directed to produce the khasra girdawari of the said revenue estate for __________, together with the relevant entries of the Roznamcha Waqiati, and that the Field Kanungo (girdawar) of the circle be directed to examine and report upon the entry complained of.

9. Pending proceedings

9.1 Save as expressly disclosed in this clause 9, no suit, appeal, revision or other proceeding relating to the said land, or to the possession thereof, is pending before any civil court or any revenue authority, and no such proceeding has been decided against the applicant. The applicant further undertakes to bring to the notice of this Office, forthwith, any proceeding relating to the said land or to the possession thereof which may be instituted, or which may come to his knowledge, after the presentation of this application.

10. Why the correction is needed

The applicant requires the entry to be corrected __________. The khasra girdawari is the record upon which cultivation and possession are proved, and so long as it stands as it does the applicant is shut out of what depends upon it.

It is therefore most respectfully prayed that this Office may be pleased to order as follows —

(a) that notice issue to every person concerned in the entry complained of, and that they be given an opportunity of being heard, as required by paragraph 9.9(f) of the Punjab Land Records Manual;

(b) that the Halqa Patwari of the revenue estate of Village __________ be directed to produce the khasra girdawari for __________ and to report upon the entry complained of;

(c) that the Field Kanungo (girdawar) of the circle be directed to examine the said entry against the harvest inspection book, the parat sarkar, the jamabandi for the year __________ and the Roznamcha Waqiati, and to report;

(d) as to the inspection of the land, as prayed in clause 8.4 above — __________;

(e) that upon such inquiry it be ordered that the khasra girdawari of the said revenue estate for __________, in respect of the said khasra numbers, be corrected in __________ so as to read as set out in clause 3.2 above;

(f) that the correction so ordered be entered by the Halqa Patwari in red ink in the harvest inspection book, be scrutinised by the area Kanungo, and be carried into the cultivation entries of the next jamabandi prepared for the said revenue estate; and

(g) that such further or other order be made as may be thought fit in the circumstances of the case.

12. Fees and court fee

12.1 The applicant undertakes to pay every fee lawfully chargeable, on demand, and to place the receipt on the file.

12.3 No ad valorem duty and no mutation fee. This application is not an instrument chargeable under the Indian Stamp Act, 1899; it creates, transfers, limits, extends and extinguishes no right, and nothing calculated upon the value of the land is payable upon it. No mutation fee under section 38 of the Punjab Land Revenue Act, 1887 is payable either, no mutation being entered or attested; the Punjab mutation fee of Rs. 600, notified under section 38 by No. S.O.31/P.A.17/1887/S.38/2020 dated 21-08-2020 and shown as payable "where ever required" in the Revenue Department's published fee table as checked on 6 September 2026, is recovered by the Revenue Officer at the time of attestation of a mutation, from the person in whose favour the mutation entry is made, under section 38(2) read with paragraph 7.33 of the Punjab Land Records Manual.

12.4 Copying. The scale the applicant has been able to find is the copying scale in paragraph 3.48 of the Punjab Land Records Manual, read with rule 71 of the Punjab Land Revenue Rules, as published and checked on 6 September 2026: Rs. 20 per page of the original for a certified copy of a jamabandi, a fard badar, a pending mutation, the counterfoils of mutation sheets and the misal haqiat; Rs. 20 for a fard haqiat irrespective of the number of khewats; Rs. 20 per four fields for tracing a field map or a tatima shajra; and Rs. 20 per inspection of the papers of one quinquennium, those fees being credited to the head "0029 - Land Revenue - 800 - other Receipts - 07 - Copying and Inspection Fee of patwaris Record". The khasra girdawari is not separately named in that scale, and the applicant requests that the entry under which any fee for a girdawari nakal is charged be stated on the receipt. The applicant does not assert that this scale is the current one and will pay whatever is lawfully demanded against a printed receipt.

12.5 A computerised nakal issued from a Fard Kendra or a Sewa Kendra is furnished under rule 71-B of the Punjab Land Revenue Rules, notified vide No. G.S.R/P.A/1887/Ss.155 and 156/Amd.2009 dated 28-05-2009, on the fee prescribed for it, which is not the rule 71 page rate set out above; the applicant will pay the prescribed rule 71-B fee against a printed receipt on being told what it is.

The scale the applicant has been able to find is the copying scale in paragraph 3.48 of the Punjab Land Records Manual, read with rule 71 of the Punjab Land Revenue Rules, as published and checked on 6 September 2026: Rs. 20 per page of the original for a certified copy of a jamabandi, a fard badar, a pending mutation, the counterfoils of mutation sheets and the misal haqiat; Rs. 20 for a fard haqiat irrespective of the number of khewats; Rs. 20 per four fields for tracing a field map or a tatima shajra; and Rs. 20 per inspection of the papers of one quinquennium, those fees being credited to the head "0029 - Land Revenue - 800 - other Receipts - 07 - Copying and Inspection Fee of patwaris Record". The khasra girdawari is not separately named in that scale, and the applicant requests that the entry under which any fee for a girdawari nakal is charged be stated on the receipt. The applicant does not assert that this scale is the current one and will pay whatever is lawfully demanded against a printed receipt.

12.5 A computerised nakal issued from a Fard Kendra or a Sewa Kendra is furnished under rule 71-B of the Punjab Land Revenue Rules, notified vide No. G.S.R/P.A/1887/Ss.155 and 156/Amd.2009 dated 28-05-2009, on the fee prescribed for it, which is not the rule 71 page rate set out above; the applicant will pay the prescribed rule 71-B fee against a printed receipt on being told what it is.
