Power of Attorney for Income Tax and GST Work

Answer what you can. The draft beside these boxes is rewritten as you go, so you can see exactly what each answer does to the document.

What you type stays in this browser. Moving to a new step asks this site to draw it, but nothing is kept anywhere until you choose to keep a copy — and closing this tab loses it.

Your answers

Nothing answered yet. There are 2 questions on this form.

Still to answer

2 answers are still to come.

Nothing is amiss in what you have written. The document is simply not finished, and the draft marks each gap where an answer will go.

  1. Where and when you sign
  2. You, the taxpayer
  3. The person you are appointing
  4. The tax work
  5. How long it lasts
  6. Witnesses

More details — you may leave these

A calendar date — the day, the month and the year. Dates in a document like this are read against one another, so a date typed here can change what another date is allowed to be.

Read the whole draft

Clearing empties every box on this form, and there is no way back to what was in them.

The live draft

The draft, as it stands

This is the document as far as you have reached, not the whole of it yet — the rest appears as you answer more questions. It is rewritten every time you change an answer.

A long blank line — __________ — stands wherever an answer has not been given. It is left that visible on purpose, so an unfinished document cannot be mistaken for a finished one.

No answer has been given, so every place a detail belongs is standing blank. The shape of the document is worth reading even now.

POWER OF ATTORNEY FOR INCOME TAX AND GST WORK

to be my true and lawful attorney, in my name and on my behalf, for the tax work described below, upon the terms of this Power.

  1. 1. THE TAX WORK

1.2 The Attorney has no authority under this Power over any other tax, any other period, or any other person's tax affairs.

  1. 2. WHAT THE ATTORNEY MAY DO

2.1 To the extent the tax laws allow a person authorised by a taxpayer to do so, the Attorney may, for the work in clause 1: prepare and file returns, statements, forms and applications; reply to notices and orders; appear before the tax officers and authorities and give them the documents and explanations they ask for; receive notices, communications and orders addressed to me; and pay tax due from my own bank account.

  1. 3. SIGNING AND VERIFYING

3.1 Where the law lets the Attorney sign or verify a return or form for me, the Attorney may do so. Where it does not, the Attorney shall prepare the papers and I shall sign or verify them myself, including any step that needs my own OTP, digital signature or Aadhaar authentication.

3.2 The Attorney shall use my portal log-in details, passwords and digital signature, if I give them, only for the work in clause 1, and shall return them to me, or tell me to change them, when the work ends.

  1. 4. TRUTH AND LIABILITY

4.1 I shall give the Attorney complete and correct information and papers. The Attorney shall file only what my records and papers support. The tax, interest and penalty that the law imposes remain my liability.

4.2 Without my written approval the Attorney shall not agree to pay extra tax, interest or penalty, make or accept a settlement, admit any liability, or withdraw an appeal.

  1. 5. THE DEPARTMENTS' OWN REQUIREMENTS

5.1 The tax departments and their portals may require the Attorney to be registered as my authorised representative in their own way. I shall do what they require, and this Power supports that step and does not replace it.

  1. 6. REVOCABLE, AND ENDS ON DEATH

6.1 This is an ordinary power of attorney. The Principal may revoke it at any time by written notice to the Attorney, under s.203 of the Indian Contract Act, 1872. It ends on the Principal's death or if the Principal becomes of unsound mind, under s.201 of that Act, whatever clause 7 says about its stated duration. It is not a power coupled with an interest.

  1. 7. DURATION
  1. 8. GENERAL

8.1 The Attorney shall act honestly and in the Principal's interest, shall keep the Principal informed, and shall keep a written account of every sum received or paid under this Power.

8.2 The Attorney may not hand this Power over to another person (sub-delegate it).

8.4 If any provision of this Power is held invalid or unenforceable, the rest continues in effect.

Reading costs nothing. Keeping a copy needs an account.

The opening of the draft is on this page as you answer it. Once every answer is in, the button below opens the whole draft, watermarked — still without an account. Printing it, or keeping a clean copy, is where an account is asked for. That is the whole arrangement.

A kept copy has to belong to somebody, and that is the reason for the account. There is nothing further to it.
