1. Who I am, and what this notice does

1.1 I am the tenant of the premises at __________ (the Premises), under the rent agreement between us dated __________ (the Rent Agreement).

1.2 By this notice I am telling you that I intend to vacate the Premises and hand over vacant possession to you on __________ (the Vacating Date). The tenancy will end on that date.

1.3 Everything else in this notice — the notice period, the rent position, the inspection, the deposit and the keys — follows from that one date.

2. The notice period

2.1 Under the notice clause of the Rent Agreement (__________), the notice period is __________.

2.4 This notice is in writing and is signed by me, and is being sent to you by the mode noted at the top. Section 106 of the Transfer of Property Act, 1882 requires a notice of this kind to be in writing, signed by or for the person giving it, and either sent by post or delivered to the other party; and it provides that the notice period runs from the date the notice is received.

3. Rent (kiraya) and other dues up to the Vacating Date

3.1 The monthly rent is __________. Rent has been paid up to __________.

3.2 I will pay the rent for the balance period up to and including the Vacating Date, on or before that date.

3.3 I will also clear the electricity, water, piped gas, internet, society maintenance and any other charges that are my responsibility under the Rent Agreement up to the Vacating Date, and I will give you the final paid receipts and meter readings at the time of handover.

3.4 Please do not adjust the Security Deposit against rent or against these charges. I am paying them separately, and I ask you to treat the deposit as a distinct amount, to be dealt with under clause 5.

4. Joint inspection before handover

4.1 I request a joint inspection of the Premises, by you or a person you authorise in writing, together with me, on __________ at a time convenient to us both.

4.2 At the inspection we can check the condition of the Premises, the fixtures, fittings and appliances that belong to you, and the meter readings, and we can record anything you say needs repair or replacement.

4.3 We should both sign a short written record of the inspection — a handover or condition report — and each keep a copy. I will also take dated photographs of every room and of the meters.

4.4 I am responsible for returning the Premises in the condition in which I received them, subject to reasonable wear and tear from ordinary use, as Section 108(m) of the Transfer of Property Act, 1882 provides. I am not responsible for ageing, for fair wear and tear, or for repairs that are the landlord's responsibility.

4.5 If neither you nor your authorised representative attends the inspection on or before the Vacating Date, I will record the condition of the Premises by dated photographs and video and by a written record signed by me and one independent witness, and I will send that record to you. It will then stand as the agreed condition of the Premises at handover.

5. Refund of the security deposit

5.1 The refundable security deposit (the security, or the advance) that I paid you is __________ (the Security Deposit).

5.2 I request you to refund the Security Deposit to me in full at the time of handover on the Vacating Date, and in any event within 15 days of the Vacating Date.

5.3 If you propose to deduct anything from the Security Deposit, please give me, in writing and before you pay out the balance, an itemised list of every deduction, with the amount, the reason, and the bill, estimate or receipt supporting it. Please do not deduct for reasonable wear and tear, for repainting unless the Rent Agreement expressly requires me to repaint, or for anything that is not recorded in the joint inspection report.

5.4 Please make the refund as follows: __________

5.5 If the Security Deposit or any part of it is not refunded within the time in clause 5.2, I reserve my right to claim it with interest and costs, and to take whatever steps the law allows to recover it.

6. Handover of possession and keys

6.1 On the Vacating Date, immediately after the inspection, I will hand over vacant and peaceful possession (khali kabza) of the Premises to you, with all my belongings removed and the Premises reasonably cleaned.

6.2 I will hand over __________ at the Premises, to you or to a person you authorise in writing, against a written acknowledgement signed by whoever takes them. I will not retain any key, duplicate key, access card or remote.

6.3 If any fitting or fixture was installed by me at my own cost and I am entitled to remove it, I will remove it on or before the Vacating Date and make good any damage that removal causes, as Section 108(h) of the Transfer of Property Act, 1882 allows.

6.4 If neither you nor your authorised representative accepts possession and the keys on the Vacating Date, I will tell you so in writing at once and send the keys to you by registered post or courier at the address above, at your risk, with the tracking details. In that case I will not be liable for rent or for occupation charges for any period after the Vacating Date.

7. What I ask you to confirm

7.1 Please confirm to me in writing, within seven days of receiving this notice: (a) that you have received this notice and accept the Vacating Date; (b) the date and time of the joint inspection; (c) the name of the person who will take possession and the keys, if it is not you; and (d) the amount of the Security Deposit as per your records.

7.2 If I do not hear from you, this notice still takes effect and I will vacate on the Vacating Date.

8. After I move out

8.1 From the Vacating Date, please send all letters, notices, the deposit refund and any documents to me at: __________. My phone number and email stay the same.

8.2 Please also give me, at or before handover, a short no-dues letter confirming that I have vacated and that nothing is outstanding, and return any post-dated cheques, blank or security cheques, and original documents of mine that you are holding.

9. General

9.1 Nothing in this notice gives up any right that either of us has under the Rent Agreement or under the law, and nothing in it is an admission of any claim or liability.

9.2 If any part of this notice turns out to be wrong in law, the rest of it still stands, and it still operates as my notice of intention to vacate the Premises on the Vacating Date.
