Stamp duty

No stamp duty, anywhere — it only exercises a right the tenancy already gives. Plain paper; anyone insisting on stamp paper is wrong. (A registered lease's 'deed of surrender' is different and can attract duty.)

Registration

Not registrable, whether or not the rent agreement was registered — section 17, Registration Act, 1908 doesn't cover a termination notice. No sub-registrar visit, fee, or time limit. A Model Tenancy Act Rent Authority may need the record updated — an intimation, not registration.

Notarisation

Not required — adds nothing to legal effect. Some ask for a notarised copy from habit; harmless, but not proof of service — what matters is evidence of when the landlord received it.

Witnesses

None needed for the notice — proof of delivery matters: the AD card, speed-post tracking, or the landlord's signature on the acknowledgement strip. If the landlord skips inspection, have one adult witness sign/date your condition record and photos.

Subject: Notice that I will vacate the premises on 3 April 2026 — request for a joint inspection and refund of the security deposit

Dear Mr. Suresh Iyer,

1. Who I am, and what this notice does

1.1 I am the tenant of the premises at Flat 402, B Wing, Silver Oak Residency, 7th Main, Koramangala 5th Block, Bengaluru 560095 (the Premises), under the rent agreement between us dated 1 April 2026 (the Rent Agreement).

1.2 By this notice I am telling you that I intend to vacate the Premises and hand over vacant possession to you on 3 April 2026 (the Vacating Date). The tenancy will end on that date.

1.3 Everything else in this notice — the notice period, the rent position, the inspection, the deposit and the keys — follows from that one date.

2. The notice period

2.1 Under the notice clause of the Rent Agreement (Clause 8), the notice period is Two months.

2.2 I am giving the full notice period required by the Rent Agreement, and the Vacating Date is on or after the day that notice period ends.

2.3 The lock-in period under the Rent Agreement has already ended.

2.4 This notice is in writing and is signed by me, and is being sent to you by the mode noted at the top. Section 106 of the Transfer of Property Act, 1882 requires a notice of this kind to be in writing, signed by or for the person giving it, and either sent by post or delivered to the other party; and it provides that the notice period runs from the date the notice is received.

3. Rent (kiraya) and other dues up to the Vacating Date

3.1 The monthly rent is ₹45,000 (Rupees Forty Five Thousand only). Rent has been paid up to 4 April 2026.

3.2 I will pay the rent for the balance period up to and including the Vacating Date, on or before that date.

3.3 I will also clear the electricity, water, piped gas, internet, society maintenance and any other charges that are my responsibility under the Rent Agreement up to the Vacating Date, and I will give you the final paid receipts and meter readings at the time of handover.

3.4 Please do not adjust the Security Deposit against rent or against these charges. I am paying them separately, and I ask you to treat the deposit as a distinct amount, to be dealt with under clause 5.
