VOLUNTEER AGREEMENT

This agreement is between __________, __________ (the Organisation), and __________, of __________ (the Volunteer), who is __________.

THE WORK

NOT EMPLOYMENT

The Volunteer gives time freely. The Volunteer is not paid a salary, wage, stipend or fee, and is not an employee of the Organisation. Neither side intends this to be a contract of employment, and the Organisation does not promise any job, benefit or future paid work.

DISPUTES

The two sides will first try to settle any disagreement by talking to each other. If that fails, the courts that have jurisdiction at the Organisation's office will decide it.

LEGAL BASIS

Punjab and Chandigarh: This is an ordinary agreement under the Indian Contract Act, 1872 between persons able to contract. Calling someone a volunteer does not by itself decide that they are not an employee; that depends on the real arrangement, including whether pay or fixed duties and hours are involved, and on the labour laws that apply to it.

PERSONAL DATA NOTICE

This notice is given under the Digital Personal Data Protection Act, 2023.

The purpose of collecting personal data in this volunteer agreement is to identify the Volunteer (and any parent or guardian), record the terms of the volunteering and support the Organisation's safeguarding and record-keeping.

If the matter does not proceed, the personal data will be retained for 90 days and then erased. If the matter proceeds, the record will be retained for the matter plus 12 months, except where a statute requires a longer named retention period.

Data minimisation: this document does not collect a full Aadhaar number, an Aadhaar-card copy, a password or bank credentials.
