Farm Machinery Rental Agreement

Answer what you can. The draft beside these boxes is rewritten as you go, so you can see exactly what each answer does to the document.

What you type stays in this browser. Moving to a new step asks this site to draw it, but nothing is kept anywhere until you choose to keep a copy — and closing this tab loses it.

Your answers

Still to answer

6 answers are still to come.

Nothing is amiss in what you have written. The document is simply not finished, and the draft marks each gap where an answer will go.

  1. The owner and the hirer
  2. The machine and the period
  3. Rent, deposit and fuel
  4. Signing

Step 1 of 4

The owner and the hirer

For example: Gurmeet Singh

What is the owner of the machine's address?Needed

A number somebody can be reached on. Ten digits is the usual Indian form, and a country code in front of it is fine if you want it there.

For example: 98140-00000

For example: Nirmal Singh

The live draft

The draft, as it stands

This is the document as far as you have reached, not the whole of it yet — the rest appears as you answer more questions. It is rewritten every time you change an answer.

A long blank line — __________ — stands wherever an answer has not been given. It is left that visible on purpose, so an unfinished document cannot be mistaken for a finished one.

No answer has been given, so every place a detail belongs is standing blank. The shape of the document is worth reading even now.

FARM MACHINERY RENTAL AGREEMENT

BETWEEN

__________, of __________, mobile __________ (the "Owner");

AND

__________, of __________, mobile __________ (the "Hirer").

  1. 1. THE HIRE

1.3 The Machine remains the Owner's property throughout. The Hirer gets only the right to use it during the Period for farm work, as clause 3 allows.

  1. 2. RENT AND DEPOSIT

2.3 If the Hirer keeps the Machine after the Period without the Owner's written consent, he shall pay rent at the same rate for every extra day or hour until it is returned, and shall be responsible for it as before.

  1. 3. USE OF THE MACHINE

3.2 The Hirer shall not sub-let, lend, pledge or sell the Machine, carry passengers or goods for hire on it, use it for any illegal purpose, overload it, or take it outside the place of use without the Owner's written consent.

3.3 The Hirer shall obey every traffic and safety law and order, including any rule on carrying a trolley or implement on the road, and shall bear every fine or penalty that arises from his own or his driver's breach of them.

  1. 4. FUEL AND UPKEEP

4.1 The Hirer shall pay for the diesel and for the daily upkeep, such as greasing, checking oil and water and cleaning, and shall keep the Machine clean and in the condition in which he received it, apart from fair wear and tear.

4.2 A fault that comes from fair wear and tear or an old defect shall be repaired by the Owner at his cost, and the Hirer shall tell him at once. The Hirer shall stop the Machine if running it would worsen the fault, and shall not make a repair himself without the Owner's consent. The rent for days the Machine cannot work because of such a fault, and is not at fault of the Hirer, shall not be charged.

  1. 5. DAMAGE, ACCIDENT AND THEFT

5.1 From the time he takes the Machine until he returns it, the Hirer has charge of it and is responsible for loss of it or damage to it, other than fair wear and tear, whether caused by himself, his driver or anyone else, including theft, and shall pay the cost of repair, or the value of the Machine if it is lost or beyond repair.

5.2 The Hirer shall tell the Owner at once of any accident, damage, theft or police matter, and shall report a theft or serious accident to the police the same day. The Hirer is responsible for injury to any person or damage to any property caused while the Machine is with him, and shall not hold the Owner liable for it. Any insurance claim shall be made by the Owner with the Hirer's help, and any amount the insurer pays shall be set against what the Hirer owes under clause 5.1.

  1. 6. RETURN

6.1 The Hirer shall return the Machine, clean and with all its parts and papers, to the Owner at the Owner's address by the end of the Period. The Owner shall inspect it at once, and the two shall sign a note of its condition on return and the meter reading. Damage not noted at return and found later shall be dealt with under clause 5 only if the Owner shows it was caused during the Period.

6.2 If the Hirer does not pay or breaks this agreement, the Owner may take the Machine back after a written notice of three days, but only peacefully and in accordance with law.

  1. 7. DISPUTES

7.1 The parties shall first try to settle any dispute by talking, if they wish with the help of respected elders or the village panchayat.

  1. 8. GENERAL

8.1 This is the whole agreement between the parties on the Machine. Any change must be in writing and signed by both.

Reading costs nothing. Keeping a copy needs an account.

The opening of the draft is on this page as you answer it. Once every answer is in, the button below opens the whole draft, watermarked — still without an account. Printing it, or keeping a clean copy, is where an account is asked for. That is the whole arrangement.

A kept copy has to belong to somebody, and that is the reason for the account. There is nothing further to it.
