When you need it

Use this when the owner of a tractor, rotavator, seed drill, thresher, trolley, sprayer or other farm machine hands it to a farmer, who will run it himself with his own driver, for a rent per day or per hour for a stated period. It records the machine and its condition at handover, the rent and any deposit, the period, who pays for fuel and routine upkeep, where the machine may be used, who is responsible for damage, accident or theft while it is with the hirer, and how it is handed back.

The machine stays the owner's property throughout; the hirer gets only the right to use it for the period and the purpose named. Not for: hiring a combine harvester or other machine with the owner's own operator to do a job on the farmer's field (use the Combine Harvester Custom Hiring Agreement); buying a tractor (use the Tractor Sale Agreement); industrial or factory machinery on a long lease (use the Plant, Machinery and Equipment Lease).

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

A short rental of a movable machine for a few days or weeks is a hire of goods and creates no interest in land, so no conveyance or lease duty is charged on it. A general agreement may attract a fixed duty under the residual agreement entry of the Punjab or Chandigarh schedule, and this drafter could not confirm one current figure, so none is stated. Ask on the official e-stamping portal or at the Sub-Registrar counter before signing, and keep the rent receipts.

Registration

Not compulsorily registrable: this agreement creates no interest in immovable property, so section 17 of the Registration Act, 1908 does not require it to be registered. The parties may still choose to register it for extra evidential weight.

Notarisation

Not required. Either party may have it notarised for extra comfort that the signatures are genuine; carry original photo ID.

Witnesses

Not required by law, but two adult witnesses who are not parties are customary in village practice and are provided for below.
