कब ज़रूरत पड़ती है

A buyer who has booked, or been allotted, a commercial unit — an office, a retail shop or showroom, or a shop-cum-office (SCO) — from a developer or promoter in Punjab or Chandigarh, and now wants to cancel that booking and get back the amount already paid, before the matter becomes a formal legal notice. Use this Letter to identify the booking or allotment being cancelled, state the reason for cancelling it, record the amount paid to date, acknowledge that the booking's own cancellation terms (if any) — and not this Letter — decide what deduction, if any, applies, and ask the Developer to confirm the cancellation in writing and refund the balance within a stated time. THE ONE THING THIS LETTER IS NOT: a legal notice, and not yet a demand. It is the Buyer's first written approach to the Developer, asking for cancellation and a refund rather than asserting a breach or threatening proceedings — this is so even where the reason for cancelling is the Developer's own delay or default. If the Developer does not reply, or does not pay, within the time this Letter asks for, the next step is a formal legal notice demanding the refund, not this same Letter sent again. This Letter is, in effect, the mirror image of the Developer's own Allotment Letter for the Unit: that letter is what the Developer issues to set a booking up, and this one is what the Buyer sends to undo it. NOT FOR a residential flat or plot — a general booking withdrawal and refund request, written for a residential or other non-commercial booking, covers that instead. NOT once the booking has already been cancelled, whether by the Developer's own written confirmation or otherwise, and only an overdue refund remains outstanding — that stage calls for a formal legal notice of demand, not a fresh request to cancel a booking that has already ended. NOT once possession of the Unit has actually been taken — a snag, warranty or handover document applies from that point, not a cancellation of the booking. And NOT the further, registered deed that finally cancels a registered Agreement for Sale, once the Developer has agreed to the cancellation this Letter asks for — that is a separate instrument in its own right, on its own stamp duty and registration footing.

This Letter asks the Developer to cancel a booking and refund money already paid. It does not itself sell, convey, transfer, limit or extinguish any interest in immoveable property — Clause 7 says so in terms — so it is not a chargeable instrument under the Indian Stamp Act, 1899 as that Act applies in Punjab or as it extends to the Union Territory of Chandigarh, and no e-stamp exists for a letter of this kind; plain paper, or the Buyer's own letterhead, is enough. This holds whether the booking rests only on a booking application or receipt, or on a signed allotment letter. If the booking has already been carried into a registered Agreement for Sale, actually cancelling that instrument, once the Developer agrees, needs its own further instrument — a registered deed of cancellation, chargeable and registrable on its own footing and stamped separately from this Letter. This Letter is only the request that starts that conversation, not that deed.

रजिस्ट्री

Not compulsorily registrable in either jurisdiction. A request of this kind creates no interest in property and transfers none, so it falls outside Section 17 of the Registration Act, 1908, whether the underlying booking is evidenced only by a receipt, by an allotment letter, or even by a registered Agreement for Sale — registering the Agreement does not make a later letter asking to cancel it registrable in turn. Keep this Letter, and the Developer's written reply to it, with the booking papers; if the cancellation is eventually carried into a registered deed of cancellation of the Agreement for Sale, that deed is presented for registration separately, in its own right.

नोटरी

Not required in either jurisdiction, and this Letter takes effect once the Buyer signs and sends it. Notarising it before a notary appointed under the Notaries Act, 1952 is optional, and is sometimes done for comfort because it creates an independent record of the date and of who signed; it proves nothing about whether the request is justified, and does not speed up, or guarantee, the Developer's reply.

गवाह

Not legally required for a request of this kind in either jurisdiction. Two witnesses to the Buyer's signature are provided for below regardless, because a dispute about when this Letter was sent, or in what form, usually comes down to proof of service rather than of content, and a witness who can be produced later is worth more than the wording of any clause. They matter most if this Letter is delivered by hand — take a signed acknowledgement at the time — and matter less if it is sent by registered post or courier, where the postal or courier record is itself the better proof.

1. The parties

1.1 This Letter is sent by Karanvir Singh Oberoi, an individual, of House No. 2116, Sector 71, S.A.S. Nagar (Mohali), Punjab 160071 ("the Buyer"), together with Simran Oberoi of House No. 2116, Sector 71, S.A.S. Nagar (Mohali), Punjab 160071 ("the Joint Buyer", and together with the Buyer, both called "the Buyer" below), to Vantage Realtors Private Limited, a company incorporated under the Companies Act, 2013 (or continuing under it from the Companies Act, 1956), of SCO 212-213, First Floor, Sector 34-A, Chandigarh 160022 ("the Developer").

2. The booking being cancelled

2.1 The Buyer had booked, or was allotted, an office unit bearing Shop No. SF-14, Second Floor, Tower C, in the project known as Vantage Business Central, S.A.S. Nagar (Mohali) ("the Project"), under Allotment Letter Ref. VRPL/VBC/ALLOT/2026-27/031, dated 1 April 2026 ("the Booking"). RERA project registration number: PBRERA-SAS81-PR0918.

3. Reason for cancellation

3.1 The reason for this request is: a change in the Buyer's own circumstances or plans, unconnected with any default by the Developer.

4. Amount paid to date

4.1 The total amount paid by the Buyer to the Developer towards the Booking, as on the date of this Letter, is ₹9,50,000 (Rupees Nine Lakh Fifty Thousand only). Particulars of the payments made: Rs 3,00,000 on 2 September 2026 by bank transfer, UTR HDFC2609020147. Rs 6,50,000 on 15 December 2026 by bank transfer, UTR HDFC2612150233.

5. What the booking terms provide on cancellation

5.1 The Buyer acknowledges that if the booking or allotment documents contain a valid term dealing with cancellation or forfeiture, that term — and not this Letter — decides what deduction, if any, applies to the amount paid on a cancellation of this kind. This differs from project to project, and this Letter does not assume, and should not be read as conceding, any particular figure.
