EPF AND PENSION DEATH CLAIM COVERING LETTER
Letter sending the papers for a claim after the death of a provident fund member
To: The Officer in charge of claims, __________, __________
Sir or Madam,
- 6. The papers. I enclose the claim form(s) prescribed by your office, filled in and signed as the form requires, and the other papers listed below. Please check them on receipt and tell me in writing, at once, if anything is missing or wrongly filled, so that I can put it right.
- 8. What I ask you to do.
(a) Acknowledge this letter and the papers in writing, and give me the claim reference number.
(b) Tell me the name and telephone number of the officer who will handle the claim.
(c) Tell me from time to time where the claim stands, and, when it is settled, the amount paid under each head and how it was worked out.
(d) If you reject any part of the claim or need more papers, tell me the reason in writing and the remedy open to me.
- 9. What I accept. I understand that a nominee is paid so that you are safely discharged, and that this does not by itself decide who owns the money as against the other legal heirs. If you pay me and it is later found that someone else had a better right, I will account to that person for what I received.
Thank you for dealing with the claim.
ENCLOSURES
LEGAL BASIS
Punjab: A provident fund account is governed by the Employees' Provident Funds and Miscellaneous Provisions Act, 1952 and the schemes made under it, including the provident fund, pension and insurance schemes. After the member's death the office pays on a claim made on the forms it prescribes, by the nominee or, where there is none, by the legal heirs. The forms, their attestation and the supporting papers are as the Provident Fund Office prescribes, and this letter does not replace them. A nominee is paid so that the office is discharged and does not by that fact alone become the owner of the money as against the other heirs; the order in which a Hindu's heirs inherit is set by the Hindu Succession Act, 1956, and other communities follow their own law. A claimant who is not satisfied can raise the matter with the office's grievance officer. A dispute among the heirs is decided by the civil court, and an appeal goes to the District Judge or to the Punjab and Haryana High Court.
Chandigarh: The same Act and schemes apply to a member whose employer is in the Union Territory, and the claim goes to the Provident Fund Office that serves the establishment. A claimant who is not satisfied can raise the matter with the office's grievance officer. A dispute among the heirs is decided by the civil court at Chandigarh, with an appeal to the District Judge, Chandigarh, or to the Punjab and Haryana High Court.
