When you need it

The covering letter that goes with the claim papers when an employee who was a provident fund member has died. It is addressed to the Provident Fund Office, or to the member's employer where the employer forwards claims, and it lists, one by one, the papers you enclose, so that the office can check them on receipt and you hold a record of what was sent.

You say whether you claim as nominee, as a legal heir or as a family member for a pension or insurance benefit, what the claim covers, who the other heirs are and into which account the money is to be paid. The claim forms themselves are the ones the office prescribes: take them from the office or its website, fill them as they say, and attach them. Ask the office, before you send, which papers and attestations it wants for your kind of claim. No stamp duty or registration is needed for the letter. Send it by hand against an acknowledgement or by registered post, and keep the proof. Not for a bank deposit (use the Fixed Deposit Claim Letter) or an insurance claim (see the Life Insurance Death Claim Letter and the Health Insurance Claim Letter). For a pension of a government pensioner, see the Family Pension Application.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Punjab and Chandigarh: no stamp duty is payable. A covering letter that sends claim papers after a member's death creates, transfers or extinguishes no right, so it is not an instrument within section 2(14) of the Indian Stamp Act, 1899, and the claimant signs it alone. The office may separately ask for an indemnity bond or an affidavit on stamp paper; those are other papers, and their duty is not part of this letter.

Registration

Punjab and Chandigarh: not registrable. A provident fund balance and a pension are money, not immovable property, so section 17 of the Registration Act, 1908 does not reach this letter. Keep a copy and the office's acknowledgement.

Notarisation

Punjab and Chandigarh: no notarisation is needed for the letter. The prescribed claim forms may need to be attested by the employer, a bank or another officer, and an affidavit may need to be sworn; follow what the form and the office say.

Witnesses

Punjab and Chandigarh: no witness is needed for the letter. The claimant signs alone; any witness or attestation on the claim form is the office's requirement.

Thank you for dealing with the claim.
