Application to start family pension after the death of a pensioner

Sir or Madam,

1. 5. What I ask you to do.

(a) Stop the pensioner's pension from the date of death, and tell me in writing whether any amount paid after that date has to be returned and how.

(b) Start family pension in my favour from the date the rules allow, and pay me the arrears from that date.

(c) Tell me in writing the rate at which family pension is payable to me, how it is worked out, and from what date.

(d) Tell me in writing the claim form and every paper you need from me and from the other members of the family, and issue a fresh Pension Payment Order or authority for my pension.

(e) Pay to me any other money that falls due to the family on the death of the pensioner under the rules, and tell me what it is and how it is worked out.

(f) Pay the amount due to the account described in paragraph 6.

1. 7. What I state. I have given the facts above as I know them. I will tell you at once if any fact changes, including if I marry again or become entitled to another pension, where the rules ask me to tell you.

1. 8. If the application is not decided. If you reject the application or do not reply within the time allowed, I will write to the head of your office and then to the pension grievance officer of the department concerned, and I am free to go to the court or tribunal that hears pension matters for the pensioner's service.

Please acknowledge this application and tell me the name and telephone number of the officer who will handle it.

LEGAL BASIS

Punjab: Family pension is paid under the pension rules that applied to the pensioner's service: for an employee of the Government of Punjab, the pension rules of that government; for a Central Government employee, the central pension rules; and for an employee of a corporation, board or other body, that body's own regulations. The rules decide who qualifies, in what order, from what date and at what rate, and the pension-sanctioning office issues the order on the papers they require. The office decides the application, and an applicant who is not satisfied can write to the head of the office and the department's pension grievance officer, and approach the court or tribunal that hears pension matters for that service. A dispute among members of the family about who is entitled is decided by the competent court.

Chandigarh: The same position applies to a pensioner of the Chandigarh Administration or of a body in the Union Territory, under the pension rules that apply to that service. The office decides the application, and an applicant who is not satisfied can write to the head of the office and the department's pension grievance officer, and approach the court or tribunal that hears pension matters for that service. A dispute among members of the family about who is entitled is decided by the competent court.

PERSONAL DATA NOTICE

This notice is given under the Digital Personal Data Protection Act, 2023.

The purpose of collecting personal data in this Family Pension Application is to identify the pensioner who died, the applicant and the other family members, record the application for family pension, and let the office start the pension or say what more it needs.

If the matter does not proceed, the personal data will be retained for 90 days and then erased. If the matter proceeds, the record will be retained for the matter plus 12 months, except where a statute requires a longer named retention period.

Data minimisation: this document does not collect a full Aadhaar number, an Aadhaar-card copy, a password or bank credentials.
