When you need it

The application to start family pension when a pensioner has died — made by the spouse, or by a child, parent or other dependant where the pension rules allow. It is addressed to the office that sanctions or pays the pension, tells it of the death, asks it to stop the pensioner's pension from the date of death, to start family pension in your favour and to pay the arrears, and lists the papers you send.

You name the pensioner's service and the rules under which the pension was drawn, give the Pension Payment Order number if you know it, say how you are related to the pensioner, and list the other family members who may also claim. The rules decide who qualifies, in what order, from what date and at what rate; the application asks the office to say what it will pay and how it is worked out, and does not state a rate. Papers to attach: the death certificate; the pensioner's pension book or Pension Payment Order, if you have it; proof of your relationship; your identity and address proofs with the Aadhaar number masked; your bank details on the office's form; and the office's own claim form. No stamp duty or registration is needed for the letter. Not for the social-security pension for the old or for widows (use the Old Age / Widow Pension Affidavit). For the provident fund and the pension scheme that goes with it, see the EPF and Pension Death Claim Covering Letter.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Punjab and Chandigarh: no stamp duty is payable. An application to a pension office to start family pension creates, transfers or extinguishes no right in itself, so it is not an instrument within section 2(14) of the Indian Stamp Act, 1899, and the applicant signs it alone. The office may separately ask for an affidavit or an indemnity on stamp paper; those are other papers, and their duty is not part of this letter.

Registration

Punjab and Chandigarh: not registrable. A pension is money, not immovable property, so section 17 of the Registration Act, 1908 does not reach this application. Keep a copy and the office's acknowledgement.

Notarisation

Punjab and Chandigarh: no notarisation is needed for the application. The office's own claim form, and any affidavit it asks for, may need to be attested or sworn before an officer, a notary or an oath commissioner; follow what the form says.

Witnesses

Punjab and Chandigarh: no witness is needed for the application. The applicant signs alone; any witness or attestation on the office's form is its requirement.
