कब ज़रूरत पड़ती है

For when the borrower has defaulted and the lender formally notifies the guarantor it intends to rely on the guarantee (liability generally co-extensive with the principal debtor, s.128, unless stated otherwise). States the guarantee, default, outstanding/overdue calculation, any cap and amount demanded — without exaggerating liability or hiding credits. A demand under an existing guarantee, not a new obligation; a disputed variation or release under ss.133-139 shouldn't be ignored.

पंजीकरण योग्य नहीं (धारा 17, पंजीकरण अधिनियम, 1908)। ऐसा कागज़ जो संपत्ति को भी भारित करे, बंधक है, जिसके लिए पंजीकरण + 2 गवाह चाहिए (धारा 59, संपत्ति अंतरण अधिनियम, 1882)।

नोटरी

आवश्यक नहीं जब तक ऋणदाता न माँगे।

गवाह

आवश्यक नहीं; सेवा का प्रमाण अधिक महत्वपूर्ण है।
