SHUTTERING AND SCAFFOLDING HIRE AGREEMENT
BETWEEN
__________, of __________ ("the Supplier", which expression shall include the Supplier's partners, legal representatives and permitted assigns), of the ONE PART;
AND
__________, of __________ ("the Hirer", which expression shall include the Hirer's heirs, partners, legal representatives and permitted assigns), of the OTHER PART.
The Supplier and the Hirer are together "the Parties".
1. THE EQUIPMENT AND THE HIRE
1.3 The Equipment remains the property of the Supplier at all times. The Hirer acquires only the right to use it at the Site for the hire period. The Hirer shall not sell, pledge, sub-hire or lend the Equipment, or move it from the Site without the Supplier's written consent.
2. DELIVERY, COUNT AND RETURN
2.3 On delivery, the Parties shall count the Equipment together and sign a delivery challan listing each item, the quantity and its condition. On return, the Parties shall count and inspect it again and sign a return challan. The challans are the record of what was delivered and what came back.
2.4 The Hirer may return part of the Equipment before the end of the hire. Rent for the returned items stops from the date they are counted back, subject to any minimum hire period.
3. RENT AND PAYMENT
4. DAMAGE AND LOSS
4.1 From delivery until it is counted back, the Equipment is at the Hirer's risk. The Hirer shall pay for any item that is lost, stolen or damaged beyond repair, and for the repair of any item that is damaged, other than fair wear and tear from proper use.
4.3 Rent continues on an item that is lost until the Hirer reports the loss in writing. The Hirer shall not cut, weld, bend, paint or otherwise alter the Equipment, nor use it for any load or purpose beyond what it is made for.
4.4 Concrete, cement and shuttering oil left on the Equipment beyond ordinary cleaning shall be cleaned off by the Hirer before return; if it is not, the Supplier may clean it and charge the reasonable cost.
5. SAFE USE
5.2 The Hirer is responsible for the design, safe erection, loading, propping and removal of the shuttering and scaffolding in the Hirer's work, and for the safety of its workmen and others at the Site, and shall keep the Supplier indemnified against any claim arising from the Hirer's use of the Equipment. The Supplier does not certify the structural adequacy of the Hirer's arrangement.
5.3 The Supplier shall supply Equipment that is in sound condition and fit for the use described, and shall replace promptly any item that the Hirer shows was defective on delivery.
6. TERMINATION AND RECOVERY
6.1 Either Party may terminate this Agreement on a material breach by the other that remains uncured for fifteen days after written notice, without prejudice to any amount already due. If rent is unpaid for fifteen days after written notice, the Supplier may take back the Equipment from the Site, and the Hirer shall allow access for that purpose.
7. DISPUTE RESOLUTION
8. GENERAL
8.1 This Agreement, together with the delivery and return challans, is the entire agreement between the Parties on the hire of the Equipment and supersedes any earlier discussion.
