Structural Engineer Appointment

Answer what you can. The draft beside these boxes is rewritten as you go, so you can see exactly what each answer does to the document.

What you type stays in this browser. Moving to a new step asks this site to draw it, but nothing is kept anywhere until you choose to keep a copy — and closing this tab loses it.

Still to answer

4 answers are still to come.

Nothing is amiss in what you have written. The document is simply not finished, and the draft marks each gap where an answer will go.

  1. The Owner and the Engineer
  2. The structure and the services
  3. Fee and payment
  4. Disputes and signing

The live draft

The draft, as it stands

This is the document as far as you have reached, not the whole of it yet — the rest appears as you answer more questions. It is rewritten every time you change an answer.

A long blank line — __________ — stands wherever an answer has not been given. It is left that visible on purpose, so an unfinished document cannot be mistaken for a finished one.

No answer has been given, so every place a detail belongs is standing blank. The shape of the document is worth reading even now.

STRUCTURAL ENGINEER APPOINTMENT

BETWEEN

__________, resident of __________ ("the Owner"),

AND

__________, of __________ ("the Engineer").

1. THE PROJECT

2. SERVICES

2.3 The Engineer shall design to the standards and codes of practice that apply to the structure, and shall state in the drawings the standards and design loads used. The Owner shall tell the Engineer in writing if the intended use of the structure, the number of floors or the loads will differ from the description in clause 1.2.

2.5 A site inspection under this Agreement is a periodic check of the structural work at the stage named. It is not full-time supervision of the Contractor, and the Contractor remains solely responsible for how the work is done, the quality of materials and the safety of workmen.

2.8 The Engineer's certificate is an independent professional opinion. The Engineer is not bound to issue it if an inspection has been missed, if the work departs from the structural drawings without the Engineer's written agreement, or if a defect found has not been corrected. The Owner shall not ask the Engineer to certify anything the Engineer has not inspected.

2.9 The Engineer shall exercise the reasonable skill and care expected of a qualified structural engineer. Any change to the structure made after the structural drawings are issued, including added floors, removed walls or columns, or a change of use, shall be made only after the Engineer has agreed to it in writing. The Engineer is not responsible for a change made without that agreement.

3. FEE AND PAYMENT

4. DRAWINGS AND COPYRIGHT

4.1 Copyright in the structural design and drawings remains with the Engineer, but the Owner is granted an irrevocable licence to use them for the construction, maintenance and any lawful extension of the structure described above, on payment of the fee due under this Agreement.

4.2 The Engineer is not responsible for any use of the design or drawings for a different site or a materially different structure without the Engineer's written consent.

5. TERMINATION

5.1 Either Party may terminate this Agreement on fourteen days' written notice. On termination, the Owner shall pay for services rendered up to the date of termination, and the Engineer shall hand over the design, drawings, inspection records and calculations prepared up to that date.

6. DISPUTE RESOLUTION

7. GENERAL

7.1 This Agreement is the entire understanding between the Parties on the services described above.

Reading costs nothing. Keeping a copy needs an account.

The opening of the draft is on this page as you answer it. Once every answer is in, the button below opens the whole draft, watermarked — still without an account. Printing it, or keeping a clean copy, is where an account is asked for. That is the whole arrangement.

A kept copy has to belong to somebody, and that is the reason for the account. There is nothing further to it.
