When you need it

You are engaging a structural engineer for a new building or a major extension. The Agreement sets out the structural design and drawings, who arranges the soil investigation, the stages at which the Engineer inspects the work on site, whether a stability certificate will be issued at the end, the fee and who owns the drawings.

Not for asking an engineer to assess an existing building — use the Structural Stability Certificate Request. Not a substitute for the architect's appointment or the contract with your contractor.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Chargeable as an agreement, not a conveyance. PUNJAB: Article 5, Schedule I-A to the Indian Stamp Act, 1899 as applicable in Punjab, residuary rate under Article 5(c). Confirm the current figure with the Sub-Registrar or against revenue.punjab.gov.in. CHANDIGARH: the equivalent agreement article under the Chandigarh Administration's table at revenue.chd.gov.in; confirm at the Sub-Registrar's office, 30 Bays Building.

Registration

Not compulsorily registrable under section 17 of the Registration Act, 1908 — no interest in immovable property is created.

Notarisation

Not legally required. Notarising is sometimes done to fix the date of signing, which can matter if the start date or timeline is later disputed.

Witnesses

Not legally required. One witness per side is common practice.

STRUCTURAL ENGINEER APPOINTMENT

This Agreement is made at Chandigarh on 1 April 2026

BETWEEN

Simran Gill, resident of House No. 302, Sector 9, Panchkula ("the Owner"),

AND

Er. Harpreet Singh, of SCO 8, Sector 20, Chandigarh, licence, registration or membership number X ("the Engineer").

1. THE PROJECT

1.1 The project site is Plot No. 302, Sector 9, Panchkula.

1.2 Description of the structure: New ground-plus-two residential house of about 4,200 square feet built-up area, with a basement

1.3 The Engineer shall work from the following architectural drawings: Architect’s drawing set dated 12 October 2026, prepared by Ar. Rohan Mehta. The Engineer relies on these drawings for the layout and dimensions of the structure.

2. SERVICES

2.1 Design. The Engineer shall prepare the structural design and structural drawings for the structure described above, within 30 days of receiving the architectural drawings and the soil investigation report.

2.2 Soil investigation. The Owner will arrange a soil investigation report from a testing agency and give it to the Engineer before the design starts.

2.3 The Engineer shall design to the standards and codes of practice that apply to the structure, and shall state in the drawings the standards and design loads used. The Owner shall tell the Engineer in writing if the intended use of the structure, the number of floors or the loads will differ from the description in clause 1.2.

2.4 Site inspections. The Engineer shall inspect the work on site at the following stages: Foundation before concreting, each floor slab before concreting, and the roof slab before concreting. After each inspection the Engineer shall record in writing whether the work conforms to the structural drawings and shall list any correction needed.

2.5 A site inspection under this Agreement is a periodic check of the structural work at the stage named. It is not full-time supervision of the Contractor, and the Contractor remains solely responsible for how the work is done, the quality of materials and the safety of workmen.

2.6 Stability certificate. On completion of the structure, the Engineer shall issue a stability certificate if, after the inspections under this Agreement, the Engineer is satisfied that the structure is stable.

2.7 Where a stability certificate is issued, it shall be in the following form or format: The format prescribed by the lending bank.

2.8 The Engineer's certificate is an independent professional opinion. The Engineer is not bound to issue it if an inspection has been missed, if the work departs from the structural drawings without the Engineer's written agreement, or if a defect found has not been corrected. The Owner shall not ask the Engineer to certify anything the Engineer has not inspected.
