Charitable Trust Deed

Answer what you can. The draft beside these boxes is rewritten as you go, so you can see exactly what each answer does to the document.

What you type stays in this browser. Moving to a new step asks this site to draw it, but nothing is kept anywhere until you choose to keep a copy — and closing this tab loses it.

Your answers

Nothing answered yet. There are 3 questions on this form.

Still to answer

3 answers are still to come.

Nothing is amiss in what you have written. The document is simply not finished, and the draft marks each gap where an answer will go.

  1. The trust
  2. Founder and first trustees
  3. Objects and starting property
  4. How the trust is run
  5. Signing and the record

Step 1 of 5

The trust

More details — you may leave these

A calendar date — the day, the month and the year. Dates in a document like this are read against one another, so a date typed here can change what another date is allowed to be.

Read the whole draft

Clearing empties every box on this form, and there is no way back to what was in them.

The live draft

The draft, as it stands

This is the document as far as you have reached, not the whole of it yet — the rest appears as you answer more questions. It is rewritten every time you change an answer.

A long blank line — __________ — stands wherever an answer has not been given. It is left that visible on purpose, so an unfinished document cannot be mistaken for a finished one.

No answer has been given, so every place a detail belongs is standing blank. The shape of the document is worth reading even now.

DEED OF CHARITABLE TRUST

Deed date: __________

NAME AND OFFICE

The trust is called __________ (the Trust). Its office is at __________.

FIRST TRUSTEES

OBJECTS

No part of the Trust's income or property may be used for the private benefit of the Settlor, a trustee, or a relative of either. A trustee may be repaid expenses actually and properly spent for the Trust, and may be paid reasonably for a separate service actually given, only so far as the law allows and the other trustees approve in writing.

TRUST PROPERTY

MANAGEMENT

ACCOUNTS

The trustees keep proper accounts of everything the Trust receives and spends, have them examined every year as the law requires, and keep them open to inspection by any trustee.

BANK ACCOUNT AND INVESTMENT

The Trust's money is kept in an account in the Trust's own name, operated by the persons the trustees authorise by resolution. Money not needed at once is placed only in the forms of investment that the law allows a charitable trust to use.

NEW AND RETIRING TRUSTEES

TAX REGISTRATION AND FOREIGN CONTRIBUTION

CHANGES TO THIS DEED

The trustees may change the working provisions of this deed by a written deed signed by all of them. No change may alter the objects so that the Trust stops being charitable, or allow any private benefit.

ENDING THE TRUST

LEGAL BASIS

Punjab: If immovable property is settled on the Trust, this deed is an instrument that creates a right in immovable property and is registered with the Sub-Registrar having jurisdiction under section 17 of the Registration Act, 1908. Whether and how the Indian Trusts Act, 1882 applies to a public charitable trust should be confirmed by a lawyer; no separate state registration of a public charitable trust is assumed here.

Chandigarh: The same registration route applies through the Sub-Registrar, UT Chandigarh. For a sector or estate property, the registered result must also be reflected in the Estate Office file under the Capital of Punjab (Development and Regulation) Act, 1952 and the Chandigarh Estate Rules, 2007.

PERSONAL DATA NOTICE

This notice is given under the Digital Personal Data Protection Act, 2023.

The purpose of collecting personal data in this charitable trust deed is to identify the Settlor, the trustees and the witnesses, record the Trust's property and objects, and support registration and the Trust's later dealings with banks and authorities.

If the matter does not proceed, the personal data will be retained for 90 days and then erased. If the matter proceeds, the record will be retained for the matter plus 12 months, except where a statute requires a longer named retention period.

Data minimisation: this document does not collect a full Aadhaar number, an Aadhaar-card copy, a password or bank credentials.

SIGNATURE

The rest stays out of view until every answer is in.

Reading costs nothing. Keeping a copy needs an account.

The opening of the draft is on this page as you answer it. Once every answer is in, the button below opens the whole draft, watermarked — still without an account. Printing it, or keeping a clean copy, is where an account is asked for. That is the whole arrangement.

A kept copy has to belong to somebody, and that is the reason for the account. There is nothing further to it.
