When you need it

Use this to start a public charitable trust in Punjab or Chandigarh — for relief of the poor, education, medical relief, caring for the environment or heritage, or another object of general public use. It names the trust, the person founding it (the Settlor), the first trustees, the objects, the starting property and the rules for running the trust and ending it.

A trust is not a separate legal person the way a registered society is; the trustees hold the property in that capacity. If you want a body with members, a general body and an elected committee, use the Society (NGO) Memorandum and Rules in this library instead. Income-tax registration for exemption, donor-deduction approval and foreign-contribution registration are separate steps with the relevant authorities, applied for after the trust exists; this deed only records the trustees' intention. Not for giving land or a building to a trust that already exists — use the Gift Deed to a Charitable Trust. Not for a private family trust, or a trust under a will.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

The Indian Stamp Act, 1899, as it applies in Punjab and in Chandigarh, decides the stamp paper. A trust deed may be charged as a settlement or as a declaration of trust depending on what is put into the trust. The article and the amount are not stated here: ask the Sub-Registrar or the e-stamp vendor before buying the paper.

Registration

Compulsory if the trust is given immovable property (land or a building): the deed is then registered with the Sub-Registrar having jurisdiction, under the Registration Act, 1908. For a trust of money or movable property only, registration is not compulsory under that Act, but registering the deed is usually the safer course; ask your lawyer. This is registration of the deed, not registration for income-tax purposes, which is separate.

Notarisation

Not required by law for the deed. A bank or an office may ask for a notarised copy; ask them first.

Witnesses

The Settlor and every trustee sign. Two adult witnesses should also sign; if the deed is registered, the Sub-Registrar will take the signatories' presence and identity proof.

DEED OF CHARITABLE TRUST

Deed date: 1 April 2026

This deed is made by Harpreet Singh, of House 118, Sector 21, Chandigarh (the Settlor), in favour of the trustees named below, who accept the trust.

NAME AND OFFICE

The trust is called Sri Guru Nanak Seva Trust (the Trust). Its office is at Sector 22, Chandigarh.

FIRST TRUSTEES

The first trustees are: 1. Harpreet Singh, son of Gurdev Singh, Sector 21, Chandigarh; 2. Naina Kaur, wife of Harpreet Singh, Sector 21, Chandigarh. Each of them accepts the trust by signing this deed and promises to carry it out faithfully.

OBJECTS

The Trust is created only for public charitable purposes. Main purpose: Relief of the poor. What the Trust will do: Run a free evening school for children from low-income families in Mohali and Chandigarh..

No part of the Trust's income or property may be used for the private benefit of the Settlor, a trustee, or a relative of either. A trustee may be repaid expenses actually and properly spent for the Trust, and may be paid reasonably for a separate service actually given, only so far as the law allows and the other trustees approve in writing.

TRUST PROPERTY

The Settlor transfers to the trustees, to hold on the trusts of this deed, the following starting property: A sum of money paid into the trust bank account, described by amount and date.. Nature of the starting property: Money or movable property only. Later gifts and donations that the trustees accept become part of the Trust property and are held on the same trusts.

MANAGEMENT

The trustees manage the Trust. Decisions are taken by a majority of the trustees present at a meeting that has a quorum. A meeting needs at least 2 trustees present to decide anything. Minutes of every meeting are written down and signed by the person who chaired it.

ACCOUNTS

The trustees keep proper accounts of everything the Trust receives and spends, have them examined every year as the law requires, and keep them open to inspection by any trustee.

BANK ACCOUNT AND INVESTMENT

The Trust's money is kept in an account in the Trust's own name, operated by the persons the trustees authorise by resolution. Money not needed at once is placed only in the forms of investment that the law allows a charitable trust to use.

NEW AND RETIRING TRUSTEES

A vacancy in the office of trustee is filled by the continuing trustees, who appoint a new trustee by a written deed. A change of trustees is recorded in a written deed signed by the retiring trustee and the continuing trustees, and the new trustee accepts the trust in writing.

TAX REGISTRATION AND FOREIGN CONTRIBUTION

Tax registration: The trustees intend to apply for income-tax registration and donor-deduction approval. Any income-tax registration or donor-deduction approval (the 12A/12AB and 80G registrations, or their equivalents under the Income-tax Act, 2025) is applied for in the Trust's own name by the trustees, who keep to the conditions of whatever is granted. Foreign contribution: The Trust will not accept foreign contribution.
