कब ज़रूरत पड़ती है

For a plot, house, booth, SCO, industrial, institutional or group-housing site allotted by one of Punjab's six urban development authorities (GMADA Mohali, GLADA Ludhiana, ADA Amritsar, JDA Jalandhar, BDA Bathinda, PDA Patiala), once you've paid the Authority everything demanded, to get a No Due Certificate and the conveyance deed executed and registered. This matters more than allottees realise: under s.43(6), Punjab Regional and Town Planning and Development Act 1995, the land stays the Authority's until fully paid — an allotment letter isn't title, only a right to have title conveyed; s.43(7) bars transfer without the Authority's prior permission. Three reasons to file rather than sit on the allotment letter: a loan is easier against a registered deed; a buyer's advocate wants a registered instrument (the GPA-plus-agreement route the Supreme Court disapproved in Suraj Lamp v. State of Haryana gets discounted); and GMADA's transfer-permission form charges 2.5% (residential/commercial) or 5% (houses) of the allotment/auction price ONLY if sought before the conveyance deed issues — getting the deed first saves that (Rs 1.25–2.5 lakh on a Rs 50 lakh site). Two notified services, askable on one file: GLADA gives 7 working days for a no-dues certificate and 15 for a conveyance deed; GMADA gives 15 days for the conveyance (no published GMADA no-dues figure, ADA/JDA/BDA/PDA periods unverified — clause 8 asks the Estate Officer to apply whichever period governs). Delay is appealable to the Additional Chief Administrator under the Punjab Right to Service Act 2011 — keep the diary receipt. On a combined filing, the certificate doesn't exist yet, so the deed limb may be split at the counter; clause 7 sequences the two limbs, or leave the deed-copies question blank and file for the certificate alone first. Do NOT use for a private-builder/colonizer purchase — PAPRA 1995 + RERA 2016 instead (promoter conveys within 3 months of possession, s.15, or faces unilateral registration under s.16; s.44 excludes authority land). Do NOT use for Chandigarh Estate Office property — a different Act, a 30-day conveyance/15-day NDC service, registered at 30 Bays Building. Do NOT use if money is outstanding — filing on a short account is a false affidavit (clause 3.2). Do NOT use where the allottee has died — heirs must first transfer by succession (GMADA: 45 days) before applying. Don't sidestep an extension-fee dispute — part of s.43(6)'s "other dues" (GMADA's ladder starts only in the 4th year). Read the Annexure A undertaking before signing: you're agreeing to pay any final/additional price the Estate Officer determines LATER, even after registration, accepting resumption (with whatever's built) if you don't — GLADA's own affidavit says so; other authorities are substantively the same. Take advice if your scheme's land-acquisition compensation is still litigated. Both joint holders take this liability (Annexure A-1 for the second holder) — the Estate Officer won't convey to one joint holder alone.

The application isn't stampable — a statutory-authority request, not an instrument under Stamp Act s.2(14). Two things ARE stamped. First, the affidavits (Annexure A, and A-1 on a joint holding) — Art.4, Sch.I-A, Punjab. GLADA's and GMADA's forms print Rs 25 non-judicial for these — buy Rs 25 unless your Estate Office specifies otherwise. Every deponent needs separate paper. Buy as conventional stamp paper — Rs 25 sits below Punjab's e-stamping threshold of Rs 49,999. GMADA separately sells its RTS booklet at Rs 15/form — a form charge, not duty. Second — the real number — the conveyance deed: one of three copies must be engrossed on full-duty stamp paper. Punjab conveyance duty is 5% + 1% Social Infrastructure Cess + 1% PIDB levy = 7% of the higher of consideration/Collector rate — no gender concession traced. UNSETTLED: whether the base is the price paid or the (often higher) Collector rate — GMADA's checklist says only 'as applicable on date of execution', pointing to the Sub-Registrar (S.A.S. Nagar for GMADA, Ludhiana tehsil for GLADA); confirm the Collector rate there first. The wrong base risks impounding (s.33), released under ss.39/40 only with the deficit plus up to 10x penalty. Buy as an e-stamp via SHCIL (SCO 154-155, Sector 17-C, Chandigarh), applicant's own name; don't buy far ahead — certificates unlocked over four months get locked (Stamp Branch order No. 07/15/2026-ST-2(PF-1)/10837, 11 July 2026). Chandigarh doesn't apply — Punjab-only, no authority allotment there. Orientation only: 5% on a sale/conveyance, registration fee 1% (cap Rs 10,000), pasting Rs 20 — the widely repeated 6% is unsupported; confirm at 30 Bays Building if relevant.

रजिस्ट्री

The application and affidavits aren't registrable — s.17(1) requires an interest-creating instrument, and this asks a statutory authority to act. Filed at the Estate Office counter/RTS window; keep the dated diary/receipt number, since the notified period runs from a complete application. The conveyance deed IS compulsorily registrable (s.17(1)(b)); unregistered, it passes no title (s.49). At the registration counter: fee 1% (cap Rs 2,00,000, possibly stale); facilitation Rs 1,000/3,000/5,000 (≤10L/≤30L/>30L); pasting Rs 200; mutation Rs 600; base is consideration or Collector rate, whichever higher. Timing: present within four months (s.23), extendable four more on a 10x fine (s.25) — beyond eight months, no cure. Don't let the engrossed copy sit once signed. File at the tehsil Sub-Registrar (S.A.S. Nagar for GMADA, Ludhiana tehsil for GLADA, relevant tehsil for others) via Punjab's NGDRS. The Estate Officer's signatory and the applicant/joint holders must appear with photo ID. After registration, apply for the change in the Authority's record and the municipal tax record. Service timelines: GLADA — 15 working days conveyance, 7 no-dues, 7 mortgage permission, 21 NOC/duplicate, 15 re-transfer on sale, 45 on death. GMADA: 15 days conveyance (website vs form disagree 15 vs 21 on transfer-permission — cite whichever chart you got); its no-dues period, and ADA/JDA/BDA/PDA's periods, aren't published. Chandigarh is outside this template: a 30-day conveyance/15-day NDC service, registered at 30 Bays Building, mutation auto-triggered since 2025 — none of the Punjab fees apply there.

नोटरी

The affidavits (Annexure A, and A-1 on a joint holding) must be sworn — unsworn, worthless at the counter. Swear before an Oath Commissioner (district court complexes: S.A.S. Nagar, Ludhiana, Amritsar, Jalandhar, Bathinda, Patiala) or a Notary. Each deponent swears separately, own paper. Insist on: personal appearance with photo ID; seal/signature/registration number; entry in the notarial register with the serial number written on the affidavit — check it, since a faint/undated one fails. Notary fees follow Rule 10, Notaries Rules 1956; Oath Commissioners charge a nominal fee. Abroad: an Indian mission's consular officer, or a foreign notary plus apostille — allow extra time with an overseas co-holder. The application itself isn't notarised — signed and witnessed; an attorney needs a certified copy of the registered POA filed, original for comparison. Nothing here substitutes for registration: a notarised affidavit is evidence of a promise, not title.

Choose independent witnesses: a joint holder or signing attorney can't witness; avoid the deed-writer, property dealer, Estate Office staff — prefer a neighbour or relative with no interest, reachable in ten years. The affidavits take NO witnesses — authenticated by the oath, not attestation. The heavier requirement comes later, at the Sub-Registrar's office for the conveyance deed: s.32/s.34, Registration Act require two identifying witnesses producing ID (PAN/Form 60), photos and thumb impressions captured electronically. The same two may serve, but must attend in person; a minor cannot be used.

  1. THE APPLICANT

I, Harpreet Singh Sandhu, son of Sardar Gurcharan Singh Sandhu, resident of House No. 1204, Sector 70, S.A.S. Nagar, Punjab 160071, am the person in whose favour the property more particularly described in the Schedule at the foot of this application (hereinafter "the said property") stands in the records of Greater Mohali Area Development Authority (GMADA), and I am entitled to have the conveyance deed of the said property executed in my favour. I may be contacted on +91 XXXXX XXXXX. Communications may also be sent to me by electronic mail at harpreet.sandhu@example.com. The said property stands in my name jointly with Manjit Kaur Sandhu, son of Harpreet Singh Sandhu, resident of House No. 1204, Sector 70, S.A.S. Nagar, Punjab 160071, who joins in this application, subscribes to every statement made in it, has signed it below, and has sworn the separate affidavit printed at Annexure A-1.

  1. THE ALLOTMENT, AND HOW I COME TO HOLD THE SAID PROPERTY

2.1 The said property was allotted by Greater Mohali Area Development Authority (GMADA) by way of allotment by draw of lots under the scheme brochure, vide allotment letter No. EO/GMADA/UE-78/AL/2019/4471 dated 1 April 2026 issued by the Estate Officer.

2.2 A re-allotment letter bearing No. EO/GMADA/UE-78/RAL/2021/1129 dated 2 April 2026 was thereafter issued by the Estate Officer, and the conveyance deed accordingly falls to be executed against that re-allotment letter. I was not myself the original allottee named in the said allotment letter. The allotment was transferred into my name with the previous permission of the Authority granted under section 43(7) of the Punjab Regional and Town Planning and Development Act, 1995, vide transfer or change-of-ownership letter No. EO/GMADA/UE-78/TR/2023/0873 dated 3 April 2026, and I hold the said property as the transferee so recognised by the Authority. I have not parted with, agreed to part with, or created any right in favour of any person in respect of the said property otherwise than as disclosed in this application.

  1. PAYMENT OF THE ENTIRE CONSIDERATION MONEY AND OF ALL OTHER DUES

3.1 The total amount demanded by the Authority in respect of the said property, comprising the allotment or auction price together with interest and every other sum demanded up to the date of this application, is ₹62,45,800 (Rupees Sixty Two Lakh Forty Five Thousand Eight Hundred only).

3.2 I have paid to the Authority a sum of ₹62,45,800 (Rupees Sixty Two Lakh Forty Five Thousand Eight Hundred only) in full and final satisfaction of that demand. The final payment was made on 5 April 2026 and is acknowledged by the Authority's receipt No. GMADA/RCPT/2026/0091277, a self-attested copy whereof is enclosed together with copies of the earlier receipts and the account statement of the said property.

3.3 As on the date of this application no instalment, interest, ground rent, extension fee, penalty, service charge or other sum whatsoever demanded by the Authority remains outstanding against me in respect of the said property. The entire consideration money having been paid, the condition in section 43(6) of the Punjab Regional and Town Planning and Development Act, 1995 — under which the said property continues to belong to the Authority until the entire consideration money together with interest and other dues has been paid — stands satisfied, and I am entitled to have the conveyance deed executed in my favour.

3.4 No Due Certificate already issued by the Authority in respect of the said property: EO/GMADA/NDC/2026/1502 dated 4 August 2026.

  1. POSSESSION AND CONSTRUCTION

4.1 As on the date of this application, physical possession of the said property has been delivered to me by the Authority, possession having been delivered to me on 4 April 2026.

4.2 As on the date of this application, the building on the said site has been completed and the completion certificate has been obtained from the competent authority. The completion or occupation certificate issued by the SDO (Building) of the Authority bears No. SDO(B)/GMADA/CC/2025/0442, and a self-attested copy is enclosed. I undertake to comply with the building rules and the zoning plan applicable to the said property, and to raise or complete construction within such period, and on payment of such extension fee, as the Authority may determine.

  1. ENCUMBRANCES AND PENDING PROCEEDINGS

The said property stands mortgaged in favour of State Bank of India, Sector 62 Branch, S.A.S. Nagar with the previous permission of the Estate Officer granted vide No. EO/GMADA/MTG/2021/2260, and that mortgage subsists as on today. The mortgage is disclosed for the record of the Authority, and I request that the conveyance deed be executed subject to it. Save as expressly stated above, the said property is free from all charges, liens, attachments, injunctions, litigation and encumbrances of every kind. No suit, appeal, revision, writ petition or other proceeding concerning the said property is pending to my knowledge, and no proceeding under sections 44 to 48 of the Punjab Regional and Town Planning and Development Act, 1995 for penalty, resumption, eviction or damages is pending against me in respect of it.

  1. SIGNATURE AND AUTHORITY

This application is signed and presented on my behalf by Jasbir Singh Grewal, my duly constituted attorney under a power of attorney registered as Document No. 3117, Book No. 4, Volume 118, Sub-Registrar S.A.S. Nagar and registered on 6 April 2026, a certified copy whereof is enclosed. The said power of attorney is subsisting, has not been revoked, cancelled or suspended, and specifically authorises the attorney to deal with the Authority in respect of the said property. I confirm that the particulars stated in this application are within my personal knowledge, are true and correct, and that nothing material has been concealed. I am aware that an application supported by a false statement renders me liable to have the relief withdrawn and to such further action as the law permits.

  1. RELIEF PRAYED FOR

It is therefore respectfully prayed that the Estate Officer may be pleased —

— to verify the account of the said property and to issue the No Due Certificate certifying that nothing remains due from me to the Authority in respect of it;

— to execute the conveyance deed of the said property in my favour under section 43 of the Punjab Regional and Town Planning and Development Act, 1995, and to cause it to be presented for registration before the Sub-Registrar of the tehsil in which the said property is situated, so that the said property ceases to belong to the Authority under section 43(6) of that Act and vests absolutely in me;

— to record the resulting change in the property register of the Authority; and

— to issue such further direction as may be necessary to complete the transfer of title.

No relief other than that set out above is sought by this application. Where the No Due Certificate has not yet been issued, I am aware that the Authority's own conveyance-deed checklist calls for a self-attested copy of that certificate as an enclosure to the conveyance deed, and I request that the certificate, once issued, be treated as that enclosure. If the Estate Officer prefers to take the two limbs in sequence, I request that this application be treated in the first instance as an application for the No Due Certificate, and that the conveyance deed limb be taken up on the same file when the certificate issues, without requiring a fresh application.
