Two parents who are separating, already living separately, divorcing or divorced, and need a detailed written plan for their child — where the child primarily lives, how time with each parent is shared, who decides on schooling, healthcare and religious upbringing, how holidays and festivals are split, and how the plan is to be reviewed as the child grows or circumstances change. Written for both parents whether or not they were ever married to each other. This is the detailed parenting plan. Where a mutual-consent divorce is also being arranged, the Mutual Divorce Settlement Terms in this library carries only a short custody summary and can refer to this Agreement by name for the particulars. Not for adopting a child — use the Adoption Deed. Not for fixing money support on its own — use the Maintenance Agreement, or the child-support option inside this Agreement if the two are being settled together.

An agreement of this kind — recording custody, time-sharing and decision-making for a child, with no transfer of property — is chargeable as an Agreement under Article 5, Schedule 1-A to the Indian Stamp Act, 1899 as applicable to Punjab, and under Article 5, Schedule I to that Act as extended to the Union Territory of Chandigarh. Both schedules have been amended in recent years and neither publishes a single easily citable, dated rate for a general agreement; confirm the amount currently chargeable with a stamp vendor or the Treasury before this Agreement is executed, and buy non-judicial stamp paper of that value or e-stamp it through the Stock Holding Corporation of India Limited (SHCIL, shcilestamp.com), the authorised e-stamping agency for both Punjab and Chandigarh.

रजिस्ट्री

Not compulsorily registrable under section 17 of the Registration Act, 1908, because it creates no right in immovable property. Where the Parents want the extra evidentiary weight registration gives, it may be presented as a Book 4 miscellaneous document at the office of the Sub-Registrar of the tehsil in Punjab, or the Sub-Registrar, Union Territory of Chandigarh at 30 Bays Building. Where this Agreement is annexed to a Family Court or Guardians and Wards Act proceeding, the court file becomes its own record and separate registration is not usually necessary.

नोटरी

Not compulsory, but both Parents should sign in the presence of, and have their signatures attested by, a Notary Public or an Oath Commissioner, particularly where this Agreement will be annexed to a court proceeding — some courts expect a short supporting affidavit from each parent confirming the Agreement was entered into voluntarily, which is a separate document this template does not draft.

CHILD CUSTODY AGREEMENT

This Child Custody Agreement (this "Agreement") is made at Chandigarh on 1 April 2026.

BETWEEN

Vikram Chopra, of House No. 411, Sector 15, Chandigarh 160015 (the "Father"),

AND

Neha Chopra, of House No. 22, Model Town, Ludhiana 141002 (the "Mother").

The Father and the Mother are each a "Parent" and together the "Parents".

RECITALS

A. The Parents are married to each other and are living separately, without a decree of divorce.

B. The Parents refer to the following order or decree of a competent court: Decree of divorce dated 11 March 2025, HMA No. 214 of 2024, Family Court, Chandigarh.

C. The Parents are the parents of the following child or children (each a "Child" and together the "Children"): Aarav Chopra, born 4 June 2019.

D. The Parents wish to record, by mutual agreement and in the best interests of the Children, how custody, time-sharing and decision-making for the Children shall be arranged, without prejudice to the power of a competent court to make or vary any order concerning the Children that the welfare of the Children requires.

NOW THIS AGREEMENT WITNESSES as follows.

CUSTODY AND RESIDENCE

1.1 Physical custody of the Children shall vest in the Mother, with the Father having visitation and parenting time as set out below.

1.2 The Children shall primarily reside at House No. 22, Model Town, Ludhiana 141002.
