Use this when you have given someone a cheque that has not yet been paid and you need your bank to stop it: the cheque was lost or stolen, was given by mistake, has a wrong amount or date, or the deal it was given for has failed. It gives the account, the cheque number, date, amount and payee, the reason, what you know about whether it has been presented, and what you ask the bank to do.

Answer from your cheque book counterfoil and your bank statement. Be honest about whether money is owed to the payee: stopping a cheque does not cancel a debt, and a cheque given for a real debt that comes back unpaid can still lead to a notice and a case under section 138 of the Negotiable Instruments Act, 1881. Act on the same day, because the bank cannot take back a cheque it has already paid. Papers to attach: a copy of the cheque leaf or counterfoil; the police report if the cheque was lost or stolen; your identity proof such as a passport, driving licence, voter card or PAN card; the bank's own stop-payment form if it has one. No stamp duty or registration is needed. Hand the letter in at your branch against a stamped copy, or send it by registered post and email, and keep the bank's written confirmation. If the bank pays the cheque after it has recorded your instruction, take it to the grievance officer first.

Punjab and Chandigarh: no stamp duty is payable. A stop-payment instruction to a bank creates, transfers or extinguishes no right between two parties, so it is not an instrument within section 2(14) of the Indian Stamp Act, 1899, and the account holder alone signs it. Do not use stamp paper; a plain sheet with the bank's stamped receiving copy is enough.

रजिस्ट्री

Punjab and Chandigarh: not registrable. An instruction to a bank touches no immovable property and so lies outside section 17(1)(b) of the Registration Act, 1908. Keep the stamped copy, because the time the bank received it is the fact that matters if the cheque is later paid.

नोटरी

Punjab and Chandigarh: no notarisation is needed. A bank may ask for its own form, signed in front of an officer; ask the branch which of its forms it wants.

गवाह

Punjab and Chandigarh: no witness is needed. The account holder signs alone, as the bank knows the signature from its specimen card.

Date: 2 April 2026, at Chandigarh

By hand, against a stamped copy

To: The Branch Manager, Punjab Mercantile Bank, SCO 41, Sector 22-D, Chandigarh 160022

From: Harjinder Singh Dhillon, House No. 214, Sector 36-A, Chandigarh 160036 (email harjinder.dhillon@example.com, telephone +91 98765 41007)

Subject: Stop payment of cheque no. 004517 drawn on Savings account ending 4821

Sir or Madam,

  1. 1. My account. I hold the Savings account ending 4821 with your branch. The account is operated as follows: Single holder. I write as the person who drew the cheque described below.
  1. 2. The cheque. The cheque is no. 004517, dated 1 April 2026, for the amount of ₹2,50,000 (Rupees Two Lakh Fifty Thousand only), drawn in favour of Gurdev Traders. It is a cheque of this kind: Account-payee cheque. I gave or sent it on 2 April 2026.
  1. 3. My instruction. I instruct you to stop payment of this cheque with immediate effect. If it is presented to you for payment, in any manner and at any branch or clearing house, please do not pay it. Please record this instruction against the cheque number in your records today, and tell me the time at which you recorded it.
  1. 4. Why I give this instruction. The reason is this: The cheque was lost. I put the cheque in an envelope on 5 December and it did not reach the shop. I found the envelope missing on 8 December.
  1. 5. Police report. Reported at Sector 34 Police Station, Chandigarh on 8 December 2026, report no. 118.
  1. 6. What I know about the cheque. To my knowledge it has not been presented. Please tell me in writing, as soon as you can, if the cheque has already been presented, has already been paid or has been returned, and give the date, so that I know whether this instruction came in time. I rang the payee on 9 December 2026 and wrote to him by email the same day.
  1. 7. The money behind the cheque. No money is owed to the payee on this cheque. I understand that stopping payment of a cheque does not cancel any money I may owe to the payee. I also understand that a cheque given to pay a debt that can be enforced in law may still lead to a notice and to a complaint to a Magistrate under section 138 of the Negotiable Instruments Act, 1881, if it comes back unpaid, whatever the reason for the return. I give this instruction knowing that, and I am responsible for it. I will pay the payee by bank transfer after the matter is sorted out.
  1. 8. The bank's charge. Debit the charge to my account. I will also sign any form of your own for this purpose, and I enclose the form if I have already filled it in.
  1. 9. What I ask you to do.

(a) Mark the cheque number as stopped in your system from the time you record this instruction.
