You and at least six other people in Punjab or Chandigarh want to form a society — a Resident Welfare Association, a charitable, literary, scientific, cultural, sports or educational body, or any other purpose s.20 of the Societies Registration Act, 1860 covers — and register it so it becomes a body corporate able to hold property, open a bank account, and sue or be sued in its own name, rather than remaining a loose, unincorporated group of individuals. s.1 of that Act needs at least seven persons to subscribe to a Memorandum of Association stating the society's name, objects, and the names, addresses and occupations of the first governing body. s.2 requires the Memorandum to be filed with the Registrar together with a copy of the Rules and Regulations for the society's management, certified by three or more of the governing body members. This document produces both, plus the covering application and the verification affidavit the Registrar's office expects, as one package. Until registration is granted, the group has no separate legal existence — a bank will not open an account in the proposed name, and nobody can sue or be sued as the society. Registration under this Act is what creates that separate existence; this document is the application for it, not the certificate itself, which the Registrar issues. Not for an already-registered cooperative house-building society's internal paperwork — see the library's other society_ documents (membership, share certificates, AGM notices and the like) for that different structure, which is formed under the Cooperative Societies Act and not this one.

सोसाइटी पंजीकरण अधिनियम, 1860 के अधीन स्वयं सोसाइटी के पंजीकरण पर कोई यथामूल्य स्टाम्प ड्यूटी प्रभारित नहीं की जाती — अधिनियम ज्ञापन अथवा नियमों पर उस प्रकार कर नहीं लगाता जिस प्रकार भारतीय स्टाम्प अधिनियम, 1899 किसी अंतरण-दस्तावेज़ अथवा पट्टे पर लगाता है। जो सामान्यतः एक छोटे मूल्य के गैर-न्यायिक अथवा शपथ-पत्र स्टाम्प पेपर की आवश्यकता रखता है, वह आवेदन के साथ संलग्न सत्यापन शपथ-पत्र है, जो पंजाब अथवा चंडीगढ़ में शपथ आयुक्त अथवा नोटरी के समक्ष शपथित किया जाता है — शपथ लेने के समय वर्तमान शपथ-पत्र स्टाम्प मूल्य पुष्ट करें, क्योंकि यह आँकड़ा समय-समय पर संशोधित होता है तथा यहाँ नहीं छापा गया है।

रजिस्ट्री

यह पंजीकरण हेतु आवेदन है, जो सोसाइटी रजिस्ट्रार के पास फ़ाइल किया जाता है — पंजाब में, उस ज़िले के फ़र्म तथा सोसाइटी रजिस्ट्रार जिसमें पंजीकृत कार्यालय स्थित है; केन्द्र-शासित प्रदेश चंडीगढ़ में, सोसाइटी रजिस्ट्रार, चंडीगढ़। सहयोजन-ज्ञापन तथा नियम एवं विनियम, प्रत्येक शासी निकाय के तीन अथवा अधिक सदस्यों द्वारा प्रमाणित, उतनी प्रतियों में फ़ाइल करें जितनी रजिस्ट्रार का कार्यालय वर्तमान में माँगता है (सामान्यतः दो प्रतियाँ, एक प्रमाणित होकर वापस की जाने हेतु), पंजीकरण शुल्क, अभिदाताओं के पहचान तथा पता प्रमाण, तथा पंजीकृत कार्यालय परिसर हेतु अनापत्ति के साथ। धारा 3A को वार्षिक साधारण सभा के चौदह दिन के भीतर, जिसमें पदाधिकारी निर्वाचित अथवा नियुक्त किए जाते हैं, तत्कालीन शासी निकाय गठित करने वाले व्यक्तियों की सूची का वार्षिक फ़ाइलिंग आवश्यक है; जो सोसाइटी लगातार वर्षों हेतु इसे लंबित रहने दे, उसे निष्क्रिय माना जाने का जोखिम रहता है। धारा 12 तथा धारा 12A के अधीन, सोसाइटी के नाम अथवा उद्देश्यों में परिवर्तन हेतु उन धाराओं द्वारा अपेक्षित बहुमत से पारित साधारण सभा का विशेष संकल्प आवश्यक है, इसके पश्चात् रजिस्ट्रार का अनुमोदन।

नोटरी

आवेदन के साथ संलग्न सत्यापन शपथ-पत्र शपथ आयुक्त अथवा नोटरी पब्लिक के समक्ष शपथित किया जाना चाहिए। रजिस्ट्रार के कार्यालय सामान्यतः यह भी अपेक्षा रखते हैं कि ज्ञापन पर प्रत्येक अभिदाता का हस्ताक्षर अनुप्रमाणित हो — नोटरी, राजपत्रित अधिकारी, कार्यरत अधिवक्ता अथवा चार्टर्ड अकाउंटेंट द्वारा, कार्यालय की वर्तमान प्रथा के अनुसार — न कि केवल अनौपचारिक रूप से साक्षित; अभिदाताओं के हस्ताक्षर करने से पूर्व विशिष्ट रजिस्ट्रार कार्यालय वर्तमान में किसे स्वीकार करता है, यह पुष्ट करें।

गवाह

ऊपर वर्णित अभिदाताओं के हस्ताक्षरों के अनुप्रमाणन के अतिरिक्त, सामान्य प्रथा यह है कि शपथ-पत्र सत्यापित करने वाला व्यक्ति इसे शपथ आयुक्त अथवा नोटरी के समक्ष सीधे हस्ताक्षरित करे, बिना पृथक सामान्य साक्षियों के। जहाँ कार्यालय फिर भी किसी हस्ताक्षर हेतु साक्षियों की माँग करे, वहाँ दो वयस्क जो स्वयं अभिदाता न हों, पर्याप्त हैं।

We, the undersigned, being not less than seven persons associated for the purpose described in the accompanying Memorandum of Association, apply for registration of a society under the Societies Registration Act, 1860, under the proposed name "Sunrise Enclave Residents Welfare Association", or failing its availability, "Sunrise Enclave Owners Welfare Society". We enclose the Memorandum of Association (Part B), the Rules and Regulations (Part C), the verification affidavit, and the other documents listed below.

PART B — MEMORANDUM OF ASSOCIATION

  1. NAME

1.1 The name of the society is "Sunrise Enclave Residents Welfare Association" (the "Society").

  1. REGISTERED OFFICE

2.1 The registered office of the Society is at Community Centre, Sunrise Enclave, Sector 115, S.A.S. Nagar (Mohali) 140307, situated in the State of Punjab.

2.2 The premises are owned by one of the founding members, who has given the society a no-objection to use it as the registered office.

2.3 Particulars: NOC dated 2 January 2026 from Harjeet Singh Gill, owner of the Community Centre premises.

  1. OBJECTS

3.1 The objects of the Society fall within charitable purposes, within the meaning of s.20 of the Societies Registration Act, 1860.

3.2 The objects of the Society, in detail, are: To manage and maintain the common areas, security, horticulture and amenities of Sunrise Enclave, Sector 115, S.A.S. Nagar (Mohali); to collect and apply maintenance contributions from residents for that purpose; to represent residents before local authorities and utility providers; and to do all things incidental to the welfare of residents of the colony..

4.1 The names, addresses and occupations of the members of the first governing body of the Society, to whom, by the Rules and Regulations, the management of its affairs is entrusted, are:
