Transfer of ownership on a court decree, family settlement or probate of Will
Beneficiaries who hold a court decree, a family settlement deed or a probated Will for a Chandigarh property and want the property transferred to their names in the Estate Office records.
Issued by: Estate Office, Chandigarh Administration
The form itself is in English, exactly as the issuing office prints it.
How to fill it in
- Download the set and print it. Fill in the printed blanks by hand, in clear block letters, with a blue or black pen.
- The application (Annexure-1) is addressed to the Estate Officer, U.T., Chandigarh. Fill in the blanks it prints: the property or plot number, the sector or phase, the share, and the other details it asks for.
- The checklist asks for: the application signed by the beneficiaries (Annexure-1), the Will if applicable, a liability affidavit-cum-indemnity bond from all legal heirs with two witnesses and notary attestation (Annexure-2), self-attested photo ID, the court decree or family settlement deed (a certified copy from the Sub-Registrar if registered, or a notarised copy if not), an attested copy of the civil suit behind the decree, the original death certificate, and any loan clearance in original (Annexure-3).
- Fill in the affidavit and other annexures only where your case needs them. Where an annexure is an affidavit-cum-indemnity bond, it is to be sworn before the notary or magistrate the checklist names, with the witnesses it asks for, on the stamp paper value printed on it.
- The checklist adds extra papers if the application is made through a GPA / SPA / Sub-GPA, or by a partnership firm or a company. Attach those only if they apply to you.
- The checklist’s notes say: documents already in the Estate Office records need not be submitted again if you point them out; a document prepared outside India must be embossed by the Finance Department, Chandigarh Administration; and false information leads to rejection, so that you must apply afresh.
- Where it goes: the checklist is for documents to be uploaded or verified at the counter. The Estate Office is at the Town Hall Building, Sector 17C, Chandigarh.
- Sign where the form asks you to, check that no blank is left empty, and keep a photocopy for yourself.
