Transfer of ownership / lease rights on intestate death (no Will)
Legal heirs of a Chandigarh property owner who died without leaving a Will and who want the property transferred to their names in the Estate Office records.
Issued by: Estate Office, Chandigarh Administration
The form itself is in English, exactly as the issuing office prints it.
How to fill it in
- Download the set and print it. Fill in the printed blanks by hand, in clear block letters, with a blue or black pen.
- The application (Annexure-1) is addressed to the Estate Officer, U.T., Chandigarh. Fill in the blanks it prints: the property or plot number, the sector or phase, the share, and the other details it asks for.
- The checklist asks for: the application signed by the applicants (Annexure-1), a liability affidavit-cum-indemnity bond from all legal heirs with two witnesses and notary attestation (Annexure-2), self-attested photo ID of all legal heirs, the original death certificate of the deceased (with an English translation if in another language), the death certificate of any legal heir who has also died, and any loan clearance in original (Annexure-3).
- Fill in the affidavit and other annexures only where your case needs them. Where an annexure is an affidavit-cum-indemnity bond, it is to be sworn before the notary or magistrate the checklist names, with the witnesses it asks for, on the stamp paper value printed on it.
- The checklist adds extra papers if the application is made through a GPA / SPA / Sub-GPA, or by a partnership firm or a company. Attach those only if they apply to you.
- The checklist’s notes say: documents already in the Estate Office records need not be submitted again if you point them out; a document prepared outside India must be embossed by the Finance Department, Chandigarh Administration; and false information leads to rejection, so that you must apply afresh.
- Where it goes: the checklist is for documents to be uploaded or verified at the counter. The Estate Office is at the Town Hall Building, Sector 17C, Chandigarh.
- Sign where the form asks you to, check that no blank is left empty, and keep a photocopy for yourself.
