For moving a booked apartment/plot/shop's contractual rights to another person before final conveyance — not yet a sale deed. Separates the transferor's promoter-facing rights from the transferee's payment obligations, instalments, transfer charges, and the promoter's approval procedure. RERA s.13/s.19 still matter — RERA gives no universal right to transfer regardless of the allotment terms.

Transferor Harpreet Singh, of Sector 35, Chandigarh, holds booking/allotment rights in ABC Heights under Allotment AL-804 dated 10 January 2025 for Tower B, Apartment 804, being Apartment/flat: 3 BHK apartment, 1,850 sq ft super area, one basement parking right..

Promoter: ABC Developers Pvt Ltd, Airport Road, SAS Nagar, Punjab. RERA project no.: PBRERA-SAS79-PR0123. Original booking price: ₹1,20,00,000 (Rupees One Crore Twenty Lakh only). Paid to promoter: ₹60,00,000 (Rupees Sixty Lakh only). Balance to promoter: ₹60,00,000 (Rupees Sixty Lakh only).

  1. ASSIGNMENT

The Transferor assigns to Aarav Sharma, of Sector 21, Panchkula, with effect as stated in clause 3, the following: All contractual booking and allotment rights capable of transfer.

Inter-party assignment consideration: ₹25,00,000 (Rupees Twenty Five Lakh only). Advance paid: ₹5,00,000 (Rupees Five Lakh only). Balance: ₹20,00,000 (Rupees Twenty Lakh only). Balance trigger: On promoter's written transfer approval.

Where the law requires the Transferee to deduct tax at source from the assignment consideration, the Transferee deducts it, deposits it within the time allowed and gives the Transferor the certificate; tax properly deducted and deposited counts as payment of that much of the consideration.
