When you need it

You paid for a unit under a scheme where the builder promised an assured return, such as monthly payments until possession, a fixed return on a commercial unit or a rental guarantee, and the builder has stopped paying. This notice sets out the promise in the words of your agreement, says how many payments are unpaid and the amount, asks for the arrears with interest as the agreement and the law allow, gives a time to pay, and says where you will go if nothing happens.

Assured-return schemes are looked at closely by the law, and the Authority or a court may treat them differently depending on how they are written, so keep your agreement and your bank statements ready. This letter is sent without giving up any other right. Not for the agreement itself — use the Assured Return / Lease Guarantee Agreement. Not for delay in possession — use the Legal Notice for Possession Delay — Residential.
